Case Summary

A case has come to light where a Nepali Hindu girl was lured into a love affair, married, and later forced to convert to Islam. The victim stated that Raja Babu Ansari, a resident of Nibiya Shah Mohammadpur under Nanpara Kotwali, runs a furniture shop in Nepal. She stated that Raja Babu trapped her in a love affair and subsequently married her. A few days after the marriage, her husband and in-laws began pressuring her to convert and ultimately forced her to accept Islam. The woman further stated that after the conversion, her in-laws continuously harassed her. Two months ago, Raja Babu divorced her by pronouncing triple talaq and married another woman. Since then, the victim has been visiting the Women’s Help Desk and Nanpara Kotwali police station seeking justice. Kotwal Pradeep Singh stated that the marriage had taken place with the woman’s consent. However, her husband remarried. He added that the couple had undergone counselling twice and that the police were fully aware of the incident. Action will be taken, and an FIR will be registered once a written complaint is received, the officer stated.

Why it is Hate Crime ?

The case has been added to the tracker under the prime category of- Crimes against women in relationships and other sexual crimes. The sub-category relevant under this is- Forced conversion after marriage. In such cases, a non-Hindu man marries a Hindu woman and the force/pressure to convert to Islam begins after marriage. In such cases, the marriage is consensual in most cases and often, there is no element of the man hiding his religious identity. The marriage could be under the Special Marriages Act where neither parties are required to convert their religion for the marriage to be considered legitimate. While the victim in such cases enters matrimony assuming that religious identity is not a barrier, the non-Hindu man starts to pressure the woman to convert to Islam after marriage. In such cases, there is application of force by the perpetrator, including, denial of the woman’s religious rights. Some of the means by which the woman is forced/pressured to convert include force-feeding beef, forced to read the Kalma, forced to wear a hijab, forced for Halala, etc. There are several instances where after marriage, the woman voluntarily converts to Islam. Such cases are often argued to be a result of religious brainwashing, however, for the purpose of documenting religiously motivated hate crimes, in the absence of the victim complaining of forced conversion, such cases do not form a part of the database. This case qualifies as a religiously motivated hate crime because the Hindu victim was specifically targeted for forced conversion after marriage, solely due to her religious identity. The victim, a Nepali Hindu girl, was lured into a relationship and marriage by a Muslim man, following which she was coerced to abandon her faith and accept Islam. The pressure to convert was exerted not only by the husband but also by his family, demonstrating a deliberate attempt to erase her religious identity as a Hindu woman. Further, the use of religious practices like forced conversion to Islam, combined with marriage and later abandonment through triple talaq, indicates that the crime was not merely a case of domestic dispute or marital discord, but was motivated by religious bias and targeted at the victim’s Hindu identity. The coercion and harassment began only after the marriage, aligning it with the sub-category of "Forced conversion after marriage" — where the primary motive is religious domination and forced erasure of the Hindu identity. Thus, the crime fits the definition of a religiously motivated hate crime because the victim was targeted, harassed, and ultimately abandoned due to her Hindu faith, making religious identity the central factor in the crime.
