Why it is Hate Crime ?
This case has been added to the tracker under the prime category- Attack not resulting in death. The sub-category relevant in this case is- Attacked for opposing radicals or trying to save victim. In several cases, Hindus are attacked for opposing religiously motivated crimes being committed against a fellow Hindu or simply for voicing an opinion opposing radical elements, who either have in the past or continue to persecute Hindus. In such cases, the initial attack against the victim, against which the Hindu was trying to defend the victim, would also need to be classified as a religiously motivated hate crime. Since the initial crime itself was religiously motivated and the subsequent crime of attempting to save the victim or speaking against the radical elements ends up inviting a violent attack, it would also be classified as a religiously motivated hate crime under this category. This case qualifies as a hate crime against Hindus because the Bajrang Dal workers were attacked specifically for their identity and role as Hindus opposing radical elements. The smugglers did not fire upon them in a random act of violence; the attack was triggered when the Bajrang Dal workers sought to stop their unlawful activity in defence of Hindu values. The workers were clearly targeted for being part of a Hindu organisation that actively resists such crimes. The Bajrang Dal workers were not passive bystanders; they intervened to oppose actions that violated Hindu sentiment. In doing so, they became direct victims of a violent attack. The firing upon them was intended to punish and intimidate them, sending a message that any Hindu who resists such radical activities could face violent consequences. Thus, the attack goes beyond ordinary crime and constitutes a hate crime. The violence was directed at Hindus precisely because they asserted themselves against actions harmful to their community. Thus, this case is added to the hate crime database.
