Case Summary

A Muslim youth, Kashif, residing in the Kichha police station area, raped and blackmailed a minor Hindu girl. The family's report detailed how Kashif initially befriended their daughter, concealing his identity. He then took her to a hotel near Pulbhatta, where he recorded a video of them engaging in sexual activity. He used this video to blackmail her and continue the exploitation. The victim's family filed a complaint, stating that Kashif had been exploiting their 11th-grade daughter for the past year and a half. Upon receiving the complaint, SSP Manikant Mishra promptly registered a case. Following an investigation, Kashif was apprehended and subsequently jailed.

When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. This indicates a premeditated intent to manipulate her based on her religious background. In cases like these, the tactic of adopting a false Hindu identity to manipulate and "ensnare" a Hindu individual is not just an act of personal betrayal but can also be interpreted as an expression of disdain or disregard for Hinduism and its customs that reflects a deeper animosity towards Hindus and their beliefs, and this is why this case has been added here. Further, it is important to note here that the victim was a minor, which essentially means that the element of consent and genuine change of conscience was missing ab initio. It is a well-established fact that children are more susceptible to manipulation since they are still developing emotionally, cognitively, and socially. Their brains are not fully matured, making them more vulnerable to influence and less capable of critically evaluating information. Moreover, subtle manipulation tactics can be difficult to detect, especially when they are employed by trusted authority figures in positions of influence. This makes it challenging for parents, to identify and address instances of religious manipulation in schools. Since the underlying offence in this case is against children of a specific faith and involves subtle tactics of indoctrination, which obviously stems from a bias against the Hindu faith, this case has been documented as a hate crime.
