Muslim youth pretends to be Hindu, marries Hindu woman then forces her to convert; rapes her and feeds her beef when she refuses

Case Summary
In Lucknow, Uttar Pradesh a Muslim man named Chand Mohammad married a Hindu woman by pretending to be Sushil Maurya. Later, when the woman was pregnant with his third child, he kicked her on her stomach leading to a miscarriage. The victim also alleged that Chand Mohammad pressured her to convert to Islam. When she refused, he burnt her with a cigarette and forcefully fed her beef. He also had unnatural sex with her. The accused Chand Mohammad used to beat the Hindu victim up every day on some pretext or the other. The accused had also threatened to kill the victim if she told anyone about her ordeal. Unable to withstand the atrocities, the woman approached one of the one-stop centres for the safety of women for help. She was rescued and the police registered an FIR in the matter and started investigating the case.
Why it is Hate Crime ?
When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. What gives this case a distinct religious angle is that the Muslim perpetrator actively hid his religion and pretended to be a Hindu to ensnare the Hindu woman. Further, when his real identity was revealed, he inflicted torture and threatened the Hindu victim to convert to Islam. He also breached the girl's religious practices by deceitfully feeding her beef. Since the religious motive of the crime is evident from these facts, this case has been documented as a hate crime.
