Case Summary
From Jamia Nagar police station area of Delhi, a woman named Preeti (name changed) lodged an FIR against her husband Abu Hasan Zaidi. The victim met Abu Hasan while working in an insurance company in 2013. Abu had introduced himself as Aditya Singh. After some time, Zaidi expressed his desire for love and then marriage. Preeti established a live-in relationship with Zaidi, alias Aditya, against the wishes of her family. Soon after, Abu Hasan Zaidi started harassing her. The victim was forcibly made to cook meat and fast. Zaidi forcefully converted her to Islam and made her Simran Ali. He also snatched away her salary. The victim alleged that when she complained about the harassment to Delhi Police, the accused threatened to make her suffer like Shraddha Walkar, the Delhi girl who was killed by her live-in-partner Aftab Poonawalla.
Why it is Hate Crime ?
When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. What gives this case a distinct religious angle is that the Muslim perpetrator actively hid his religion and pretended to be a Hindu to ensnare the Hindu woman. He not only inflicted torture by harassing her and forcing her to cook beef but also forcefully converted her religion against her will. Since the religious motive of the crime is evident from the above-stated facts, this case has been documented as a hate crime.
