Muslim man poses as Hindu to trap Hindu woman, rapes her multiple times and forces her to abort, then leaves her to marry a Muslim girl

Case Summary
In the Muzaffarnagar district of Uttar Pradesh, a Hindu girl complained against one Faiz Alam to the SSP of the district on December 19, 2023. A Hindu girl from Panipat in Haryana said in her complaint that Faiz Alam, a resident of Kala village in Muzaffarnagar, met her posing as Suraj. Faiz Alam concealed his identity and lured the victim, establishing a sexual relationship with her. Faiz Alam stayed with the victim in a house in Muzaffarnagar for about one and a half years. Later, he took the victim to Bengaluru where he continued sexually exploiting her. When the victim started insisting on marriage, the accused avoided the topic. Meanwhile, the victim became pregnant. Faiz falsely assured the girl that they would get an early court marriage and on November 24, 2023, fraudulently fed her medicines to terminate the pregnancy. Due to the effect of this medicine, her 3-month foetus was miscarried and the victim's health started deteriorating. Faiz did not get her treatment and fled right after the miscarriage. When the victim's family went to his house to seek him, they discovered that he had married a Muslim girl named Fauzia. The victim got to know his true religious identity for the first time. The victim alleged that Faiz Alam threatened to kill her if she complained to the police. He also duped her of a lot of money while living together. The police have taken cognisance of the matter and started an investigation.
Why it is Hate Crime ?
When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. In this case, a non-Hindu man concealed his religious identity and pretended to be a Hindu to lure a Hindu woman. Since the religious motive of the crime is evident from the fact that the man pretended to be a Hindu to trap a Hindu woman, this case has been documented as a hate crime.
