Muslim youth poses as a Hindu, drugs, rapes and records the act, forces her to do Nikah and move to Pakistan when she finds out real identity

Case Summary
In Uttar Pradesh's Madiyaon police station of Lucknow, a Muslim youth named Mohammad Mazhar posed as a Hindu named Rahul to lure a married Hindu girl. The Sitapur resident victim had a dispute with her husband and came to Lucknow’s Madiyaon a few months ago. While searching for rented accommodation, she encountered petrol pump operator Mohammad Hasan. Hasan gave the Hindu woman’s mobile number to accused Mazhar who talked to the victim pretending to be Rahul and promised to help her in finding a home. The two soon started talking over the phone frequently and the accused proposed marriage. Mazhar raped the Hindu victim by intoxicating her and filmed an obscene video, which he kept using as blackmail to sexually abuse her repeatedly. When the victim learned about the real identity of Rahul, she confronted the accused. The victim alleged that Mazhar started pressuring her to convert to Islam along with her children, perform Nikah with him and move to Pakistan. Accused Mazhar would arrange fake passports and visas as well. He threatened to kill her, along with her husband and children when she objected. The police registered a case against accused Mohammad Mazhar, his brother-in-law and a friend under relevant sections. The accused was arrested and further investigation is underway.
Why it is Hate Crime ?
When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, to document hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. In this case, a non-Hindu man concealed his religious identity and pretended to be a Hindu to lure a Hindu woman. He used violence to force the Hindu woman to adopt a different religion against her will. Since the religious motive of the crime is evident from these facts, this case has been documented as a hate crime.
