Muslim man befriends a Dalit girl by posing as Hindu, spikes her drink, rapes her and records video, forces her to convert to Islam

Case Summary
In Lucknow, Uttar Pradesh, one Shoaib befriended a 23-year-old Dalit girl by pretending to be a Hindu named Saurabh. As their friendship progressed, he visited the victim's house in 2019 and made her a spiked drink which made her lose consciousness. He then sexually assaulted her and recorded videos of the act to blackmail her later. After she regained consciousness and protested, he consoled her using the excuse of marriage. The perpetrator frequently raped her after that. When the victim eventually discovered his religious identity, enraged Shoaib physically assaulted her and ran from there. He then called her and said that if she revealed his truth to anyone, he would release her private pictures and videos on social media. The culprit further began pressuring her to embrace Islam, threatening to harm her family if she did not obey him. The victim revealed that during his visits to her house, the accused had taken her signatures on black paper on several occasions. A case was filed after the victim's complaint and efforts are being made to nab the accused.
Why it is Hate Crime ?
When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. What gives this case a distinct religious angle is that the Muslim perpetrator actively hid his religion and pretended to be a Hindu to trap the victim. He purposely hid his religion to deceive the Hindu girl. Further, when his real identity was revealed, he assaulted her and threatened the Hindu victim to convert to Islam.
