Case Summary

In Bhilai Nagar, of the Durg district, Chhattisgarh, a 26-year-old Hindu woman faced prolonged sexual exploitation, deception and forced conversion attempts by a Muslim man named Badshah Khan. According to the victim, she first met the accused in January 2016, when she was 17 years old. Badshah Khan lured her into a relationship under the false pretences of love and marriage. He sexually exploited her based on false promises for over 10 years. During this prolonged sexual exploitation, the victim became pregnant thrice. She stated that Badshah forcibly made her undergo abortions during the first two pregnancies, while on her third pregnancy, she insisted on keeping the child. He manipulated her into signing a document written in Urdu claiming they were now husband and wife. However, no formal marriage or Nikah ever took place. The victim further reported that upon reaching Badshah's house, she was subjected to intense pressure from him and his family to convert to Islam. She was forced to consume beef, stopped from performing her religious practices, and made to recite Kalma and perform namaz. The victim stated that she was also physically assaulted whenever she resisted and sometimes was beaten so severely that she was left bedridden for days. When her son turned five, he was circumcised without her consent. The victim also revealed that Badshah ran a business under the name "Chhattisgarh Studio", where he would lure young girls by promising to make them heroines. The accused also made her pictures and phone number viral on Facebook by writing "Full Night Enjoy, Book Now". Badshah also forced her to have physical relations with others. The victim endured all this because she thought that one day the accused would marry her. As of the date of writing this report, the accused was arrested by the police under sections 376(2)(N), 313 (abortion) of the IPC, POCSO Act, and other sections. The investigation was ongoing.

It is pertinent to understand here that when the victim is a minor, the ‘consent’ to convert or enter into a romantic relationship with an adult itself is redundant – addressed by POCSO. While every case of conversion of a minor and incidents of establishing a physical relationship with a minor by an adult is a crime, for the purpose of this database, a case would be considered a hate crime only if there is a distinct religious angle to the grooming. For example, in the UK, if a Hindu minor is targeted by Pakistani grooming gangs, it would be considered a hate crime because the victims are specifically targeted owing to their non-Muslim religious identity with the perpetrators being Muslim. In other cases, if a Hindu minor is brainwashed into entering a physical relationship with the non-Hindu adult perpetrator and the family alleges grooming/brainwashing of the minor to convert her religion, it would form a part of this database. Cases where a Hindu woman consensually converts to Islam in a relationship will be left out of the hate crime database, even though it could be argued in several cases that the conversion was a result of religious brainwashing. If the victim is a Hindu adult, the case would form a part of this database only if the victim herself says that she was brainwashed/groomed to convert her religion. However, if the victim is deceased (murdered or otherwise), the case would form a part of this database if her family/friends provided testimony that the victim was brainwashed/groomed to convert her religion. Here, the victim was a minor when she was lured by the false promise of love and marriage and on the basis of that, she was sexually exploited for nearly 10 years. She was continuously coerced into converting her religion. She was force-fed beef, made to recite kalma and perform namaz, all an attempt to convert her. These actions, which were enforced against her will, signify a deliberate effort to force her to abandon her Hindu identity and adopt a different religious practice under duress. Forcing a Hindu to consume beef is not only a profound disrespect to their religious beliefs but also constitutes a religiously motivated hate crime. In Hinduism, cows are revered as sacred animals, symbolising life and sustenance, and the act of consuming beef is considered highly sacrilegious by many Hindus. Therefore, compelling a Hindu to eat beef goes beyond mere dietary imposition; it is an intentional violation of their religious principles and an assault on their cultural and spiritual identity. In the broader context of hate crimes, forcing someone to engage in behaviour that is expressly forbidden or offensive in their religion is a clear manifestation of religious intolerance. It demonstrates a blatant disregard for the victim's rights to practice their faith freely. Here, the actions of the perpetrator clearly point towards the deep disdain he harboured for Hindus and their religious beliefs. It is evident that the perpetrator targeted the victim because of her religious identity and that his motivation was driven by religious hate. Additionally, she was prohibited from visiting temples or performing pooja, all of which were an attempt to alienate her from her Hindu faith and cultural identity. Her son was also forcefully circumcised without her consent, which was a manipulation tactic and a tool for blackmail and coercion. Though circumcision is not a prerequisite to converting to Islam, however, it is often seen that it is used as an intimidatory tactic to make the Hindu victim abandon his/her religion and adopt the religion of the perpetrator. This sort of harassment is rooted in animosity towards the victim’s religious identity. The perpetrator specifically targeted the victim because of her Hindu faith. He manipulated her into a relationship under false pretences, raped her, and then pressured her to convert to Islam. This highlights a pattern of manipulation and sexual exploitation, all centred around forcing her to change her religious beliefs. Such actions are designed to intimidate, control, and harm Hindu victims because of their background. It is also important to mention that since the victim was a minor when her whole ordeal started, thus, there was an absence of both consent and a genuine change of conscience. It is a well-established fact that children are more susceptible to manipulation since they are still developing emotionally, cognitively, and socially. Their brains are not fully mature, making them more vulnerable to influence and less capable of critically evaluating information. Consequently, cases involving religious manipulation of minors not only represent an infringement on an individual's religious freedom but also demonstrate a calculated strategy of targeting those who are less able to resist or understand the long-term implications of conversion, making it a significant case of religious-motivated hate crime.
