Hindu woman lured into marriage by Muslim man pretending to be Hindu; forced to eat beef, offer namaz

Case Summary
A Hindu woman was lured into marriage by a Muslim man using a false Hindu name. Shamsher Ansari, who initially introduced himself as Tiger to the victim, forced her to convert to Islam, assaulted her, and forced her to eat beef. He also forced her to wear a burqa, offer namaz, and had threatened her with an acid attack. The victim, who hails from Jamui, Bihar, approached the Superintendent of Police (SP) Kushinagar, after which a case was registered and Ansari was arrested by the police. Around five years ago, the accused began speaking to her over the phone, pretending to be Hindu. He manipulated her emotionally and convinced her to live with him under the pretext of marriage. Eventually, she discovered through his Aadhaar card that his real name was Shamsher Ansari. The revelation left her deeply shaken, but when she confronted him, he responded that had he revealed the truth earlier, she would never have agreed to be with him. Following this, the woman stated that he forced her to eat beef and pressured her to convert her religion to Islam, and subjected her to regular beatings. Despite becoming pregnant, she was beaten up. She tried to endure the abuse for the sake of her child. After the child was born, she managed to escape from Shamsher’s house and approached the Superintendent of Police in Kushinagar. She informed him that Shamsher had forced her to wear a burqa, offer namaz, and had threatened her with an acid attack. Upon hearing her account, the SP promptly ordered an FIR to be filed and directed his team to arrest the accused. The matter had remained buried for a while due to local pressure, including support for Shamsher from his village head. The woman had continued to seek justice but received little support initially. Once the FIR was registered, the police verified the information and found it credible during the preliminary investigation. Shamsher Ansari alias Tiger was arrested and charged under sections 69, 191(2), 115(2), and 352 of the Bharatiya Nyaya Sanhita. He was subsequently sent to jail.

Such cases are often argued to be a result of religious brainwashing, however, for the purpose of documenting religiously motivated hate crimes, in the absence of the victim complaining of forced conversion, such cases do not form a part of the database. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman faces threats or assault after she refuses to convert and change her religious identity owing to pressure/force by the non-Hindu man. Further, the religious angle of the crime became more apparent when the Muslim man continued to take advantage of her physically under the guise of marriage. He pressured her to adopt Islamic practices like wearing a burqa and offering namaz. Additionally, he also forced her to consume beef. Forcing a Hindu to consume beef is not only a profound disrespect to their religious beliefs but also constitutes a religiously motivated hate crime. In Hinduism, cows are revered as sacred animals, symbolising life and sustenance, and the act of consuming beef is considered highly sacrilegious by many Hindus. Therefore, compelling a Hindu to eat beef goes beyond mere dietary imposition; it is an intentional violation of their religious principles and an assault on their cultural and spiritual identity. In the broader context of hate crimes, forcing someone to engage in behaviour that is expressly forbidden or offensive in their religion is a clear manifestation of religious intolerance. It demonstrates a blatant disregard for the victim's rights to practice their faith freely. Here, the actions of the perpetrator clearly point towards the deep disdain he harboured for Hindus and their religious beliefs. It is evident that the perpetrator targeted the victim because of her religious identity and that his motivation was driven by religious hate.
