Case Summary

In Madhya Pradesh’s Indore, Moin Khan, a resident of Lal Gali was arrested after a 17-year-old Hindu girl filed a case of sexual assault and love jihad. On January 14, the culprit appeared in court and was then taken into custody. Hindu groups gathered at the police station, held placards, and urged for severe measures to be taken against the offender. The protests arose due to dissatisfaction with the handling of the case. The victim's father filed a written complaint with the police, alleging that the perpetrator had lured his daughter to an Oyo Hotel in Pardeshipura and coerced her into a physical relationship. Despite her resistance, he persisted and even recorded a video of her, threatening to share it on social media. Additionally, he issued death threats to her. The minor girl was interviewed by the police in a closed room in the presence of a female officer. Her father revealed that she remained silent for a considerable period and had not spoken about the incident. However, on January 13th, she disclosed that she was acquainted with a local man named Moin Khan. The accused allegedly picked her up from Pardeshipura and took her to a hotel in Bicholi Mardana on September 17, two months after her birthday. He forced her into a sexual relationship against her will and threatened her with severe consequences when she objected. After dropping her home, he pressured her to meet him again. Sub Inspector Kamal Raghuvanshi reportedly ignored the family's concerns as they waited for four hours at the police station. However, their grievances were addressed following a protest by Hindu groups. Hindu activists accused Moin Khan of withdrawing Rs. 25,000 from the girl's father's account and creating a video to defame her. They also alleged that Khan demanded Rs. 5 lakh by coercing the juvenile to convert to Islam.

Why it is Hate Crime ?

In this case, there are two distinct components which prove that the offence was committed coupled with a religious bias hence this case has been classified as a religious hate crime. The first factor is that the accused blackmailed the victim to convert to Islam. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman is blackmailed to convert her religion, owing to her religious identity of being a Hindu. Such relationships may be consensual with the religious identity of the non-Hindu man known to the victim, however, there could be cases where the relationship is not consensual and the non-Hindu man starts blackmailing a Hindu woman to convert her religion. In these cases, it is often seen that the Hindu woman is blackmailed with intimate photos and/or videos, threats of harm to her or her family, threats of violence etc. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes. The second component in this case which makes it worthy of being documented as a religiously motivated hate crime is that the Muslim perpetrator sexually assaulted the Hindu victim for refusing to accede to his conversion demands. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman faces pressure/threats/violence to convert and change her religious identity by the non-Hindu man. Such relationships may be consensual with the religious identity of the non-Hindu man known to the victim. Somewhere along the relationship, the non-Hindu man starts pressuring the Hindu woman to convert. In some of these cases, the association could be non-consensual as well or, the religious identity of the non-Muslim man could be previously unknown to the Hindu victim. As the case may be, in such cases, the non-Hindu man forces himself sexually on the Hindu woman when she refuses his advances and pressures to convert her religion. The rape of the woman is often seen as either a punishment for the woman refusing to convert. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes.
