Hakim poses as Hindu healer, rapes Hindu woman on pretext of treatment and forces her to convert to Islam
Case Summary
A case of gang rape involving a Hindu woman from the Yadav community in Etah district, Uttar Pradesh, surfaced. The accused, identified as Hasim from Muzaffarnagar, posed as a doctor and exorcist. He kidnapped the victim under the guise of treatment, kept her hostage, and subjected her to gang rape with his associates. The victim, originally from the Katghar police station area of Moradabad, rented a room in Jalesar, Etah, where she taught her child. She sought treatment from Hashim for a disease called Leukorrhea, who claimed it was caused by black magic and promised a cure. Hashim, pretending to be Hindu, convinced the victim to accompany him to Loni, Ghaziabad, where she discovered his true identity. He allegedly raped her, forced her to convert to Islam, and subjected her to further gang rape with two others. The victim managed to escape on March 13 when Hashim forgot to lock the room. Despite informing the district SP in a letter on April 13, 2023, no action was taken, prompting the victim to file a case against the accused in court.
Why it is Hate Crime ?
This case has been added under two prime categories of the tracker. The first is- Attack not resulting in death, within which, the sub-category selected is- Attacked for Hindu identity. In several cases, Hindus are attacked merely for their Hindu identity without any perceived provocation. A classic example of this category of religiously motivated hate crime is a murder in 2016. 7 ISIS terrorists were convicted for shooting a school principal in Kanpur because they got ‘triggered’ seeing the Kalava on his wrist and tilak that he had put. In this, the Hindu victim had offered no provocation except for his Hindu religious identity. The motivation for the murder was purely religious, driven by religious supremacy. Such cases where Hindus are targeted merely for their religious identity would be documented as a hate crime under this category. The second category relevant here is- Predatory Proselytisation and under this, the sub-category chosen is- Harassment, threats, coercion for conversion. Harassment covers a wide range of behaviours of an offensive nature. It is commonly understood as behaviour that demeans, humiliates, and intimidates a person, including threats and coercion. Harassment and threats, in this case, find their root on discriminatory grounds which has the effect of nullifying a person’s rights or infringing upon his freedom to exercise his right specifically owing to the victim’s religious identity. Verbal and physical threats and psychological or physical harassment are often used against Hindu victims because they choose to practice their professed religion. Religious harassment also includes forced and involuntary conversions by harassment, threats or coercion. Coercion includes intimidatory tactics like force-feeding a Hindu victim beef to convert to another religion, forceful circumcision etc. In several cases documented, non-Hindu perpetrators or those who harbour specific animosity towards Hinduism, harass victims simply based on their religious identity. Such cases often also include harassment to ensure the Hindu victim abandons his/her professed religion and adopts the religion of the perpetrator. In this subcategory, we would only include cases where the victim was harassed, threatened or coerced to convert. Cases where attempts were made to convert but the victim resisted would be documented in another sub-category. Such cases where Hindu victims are harassed to convert to the perpetrator’s religion are rooted in animosity towards the victim’s religious identity and are therefore documented as religiously motivated hate crimes. In this instance, it is not explicitly mentioned that the Hindu victim was assaulted for being a Hindu but it is obvious by the fact that the Muslim accused posed as a Hindu healer to gain the victim's confidence. The religious motive of the crime becomes more pronounced as the accused assaults the victim after gaining her trust. When an accused individual deliberately hides their religious identity and pretends to belong to the victim's faith, it can be interpreted as a deceitful act aimed at gaining the victim's trust under false pretences. This behaviour might be considered evidence of malafide (bad faith) intentions, as it suggests a premeditated effort to manipulate or trap the victim. Such actions could indicate an ulterior motive that is rooted in animosity towards the victim’s religious identity. Further, the perpetrator forced the victim to convert to Islam. Since the motivating factor of the crime was the religious identity of the victims and the accused employed violence and intimidation to disenfranchise the victim from it, the case has been documented as a religiously motivated hate crime in this Hindu hate tracker.
