Case Summary

A minor Hindu girl was first groomed, then abducted and raped by several Muslim perpetrators. The accused men have been identified as 50-year-old Shah Alam, a resident of Pairora village with 30-year-old Irfan alias Babu, a native of Pairora village and 25-year-old Nadeem Qureshi, a resident of 44-Delhi Gate near Madina Mosque, Bulandshahar. The minor Hindu girl knew Shah Alam as the father-in-law of the sarpanch of the village. As Alam was known to her and he was constantly calling her, she entertained the calls. Alam gained the trust of the minor and the Hindu girl went to meet him when he called. On the day of the crime, Alam called the girl and when she sat in the car, he intoxicated her and abducted her. The brother of the victim, who filed the complaint, said that the girl had said she was leaving the house to get a blouse stitched but never returned home. Following the abduction, the accused took the minor to Kashipur, Uttarakhand kept her in his captivity and raped her. After raping her multiple times, Alam called his friend, Irfan, he also raped her. Later they took her to Noida where Nadeem Qureshi again raped her. Soon, they took the minor back to Kashipur, it was then the police tracked them through surveillance. The three have been arrested by the police.

Why it is Hate Crime ?

In our database, we have not added incidents where women have converted to another religion of their free will and no allegations of forced/involuntary conversion have been made. However, there are certain cases of conversion where the consent itself is a result of the brainwashing or grooming of a minor by the non-Hindu perpetrator trying to victimise a woman for her Hindu religious identity. The phenomenon of grooming points to non-Hindu perpetrators identifying their Hindu victims’ vulnerabilities and exploiting them over months and sometimes years, to extract the supposed ‘consent’ in order to convert their religion. In most cases of grooming, the victims are minors or the grooming started when the victim was a minor. In other cases of grooming, the non-Hindu perpetrator brainwashes and grooms a minor victim to extract their trust and then proceeds to rape them repeatedly with the intent of converting them to their faith. It is pertinent to understand here that when the victim is a minor, the ‘consent’ to convert or enter into a romantic relationship with an adult itself is redundant – addressed by POCSO. While every case of conversion of a minor and incidents of establishing a physical relationship with a minor by an adult is a crime, for the purpose of this database, a case would be considered a hate crime only if there is a distinct religious angle to the grooming. For example, in the UK, if a Hindu minor is targeted by Pakistani grooming gangs, it would be considered a hate crime because the victims are specifically targeted owing to their non-Muslim religious identity with the perpetrators being Muslim. In other cases, if a Hindu minor is brainwashed into entering a physical relationship with the non-Hindu adult perpetrator and the family alleges grooming/brainwashing of the minor to convert her religion, it would form a part of this database. If the victim is a Hindu adult, the case would form a part of this database only if the victim herself says that she was brainwashed/groomed to convert her religion. However, if the victim is deceased (murdered or otherwise), the case would form a part of this database if her family/friends provided testimony that the victim was brainwashed/groomed to convert her religion. Since these crimes have a distinct religious angle where the victim is being targeted owing to her Hindu religious identity, these cases are considered a hate crime. In this case, the minor was groomed by 50-year-old Shah Alam who abused the relationship of trust that he had built with the victim. After grooming her to trust her, he abducted the minor and raped her, including getting her raped by other Muslim perpetrators. This case is eerily similar to the grooming gangs in the UK where minors were first groomed to trust the perpetrators and later, they were abducted and raped repeatedly. Such contempt for non-Muslim victims has been seen several times in the past. Since the perpetrator was in a position of authority, it was easier for him to establish a fiduciary relationship and exploit the minor. Such a case is driven by feelings of religious supremacy where non-Hindu girls, especially minors, are exploited and raped with disregard for their liberty and freedom. This case is therefore being categorised as a religiously motivated hate crime.
