Married Muslim man poses to be Hindu and tricks a Hindu girl to marry him on the pretext of getting her a job
Case Summary
On June 14, Ambikapur police arrested a 45-year-old man named Noor Alam Khan from Balrampur, Chhattisgarh, for alleged human trafficking. He had promised a job in Gujarat to a tribal Hindu girl, posing as a Hindu named Rahul Singh. Sharmili Netaam introduced the victim, Madkam, to Noor Alam, who convinced her of a job opportunity in Gujarat. Noor Alam, posing as Rahul Singh, arranged a fake court marriage certificate, intending to marry Madkam. However, when Madkam discovered his true identity while preparing the affidavit, chaos ensued. Noor Alam attempted to flee but was apprehended and beaten by onlookers before being handed over to the police. It was revealed that Noor Alam had a wife and four children. Both Noor Alam and Sharmili Netam were booked under various sections of the Indian Penal Code and sent to judicial custody after being produced in court.
Why it is Hate Crime ?
This case has been added to the tracker under the primary category of- Predatory Proselytisation. Within this, the sub-category selected is- Conversion/attempts to convert by inducements. Predatory Proselytisation is not just limited to threat, harassment, force and violence, but it also has contours of stealth. In several cases, the Hindu victim is exploited to convert, with non-Hindus taking advantage of their poverty. In such cases, the Hindu victim who is suffering financially is offered monetary benefits, including lucrative offers for jobs, health treatment, education, etc, to induce the victim into changing his/her religion. In such cases, the religious identity of the victim and the aim to disenfranchise him from his faith form the heart of the crime. Also, taking advantage of and exploiting an individual’s economic vulnerabilities is widely acknowledged as exploitation, forms of which are often penalised by law. Such cases therefore are considered religiously motivated hate crimes since the victim’s religious identity forms the very heart of the crime itself. The second primary category selected is- Crimes against women in relationships and other sexual crimes. Within this, the sub-category selected is- Man Pretends to be Hindu, and the tertiary category chosen is- Name changed. When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. In this case, firstly, a non-Hindu man concealed his religious identity and pretended to be a Hindu to lure a Hindu woman. This itself is a clear manifestation of bias and malicious intent towards the victim's religion. By concealing his true identity, he exploited her trust, targeting her under false pretences. This indicates a premeditated intent to manipulate her based on her religious background. In cases like these, the tactic of adopting a false Hindu identity to manipulate and "ensnare" a Hindu individual is not just an act of personal betrayal but can also be interpreted as an expression of disdain or disregard for Hinduism and its customs that reflects a deeper animosity towards Hindus and their beliefs, and this is why this case has been added here. Secondly, the accused lured the Hindu woman on the pretext of getting her a job. The use of inducements to convert individuals is indeed a common tactic in efforts to influence or manipulate vulnerable individuals into changing their faith. This approach often targets economically disadvantaged groups, offering material benefits such as jobs, food, money, or livestock in exchange for conversion. It creates a form of dependency that can alienate individuals from their original faith, as they may feel compelled to convert not out of genuine belief but due to immediate needs or financial pressures. Here, too, the accused adopted a similar tactic of exploiting the vulnerability of the Hindu woman to convert her. Since exploiting vulnerabilities for the explicit purpose of conversion is purely based on animosity towards the victim's faith, this case has been categorised as a religiously motivated hate crime.
