Case Summary

In the Ratabari area, located within the Sribhumi district of Assam, a 14-year-old Hindu girl with hearing and speech disabilities was abducted and gang-raped by Muslim men. According to media reports, the accused were identified as Islam Uddin, Monir Uddin, Dilawar Hussain, and a Muslim minor. On the day of the incident, the Hindu victim was travelling to her uncle’s house to celebrate Krishna Janmashtami, a sacred Hindu festival celebrating the birth of Lord Krishna, accompanied by her younger brother. During the journey, Islam Uddin and the other three perpetrators pushed her brother to the ground and forcibly took the girl into an autorickshaw. Then they proceeded to gang-rape the minor victim in turn. The girl’s brother rushed home and informed their parents of the attack. A search party was organised, and the victim was later found by the roadside, where she had lain unconscious for three hours. She was immediately taken to the hospital for treatment. SSP (Sribhumi) Parha Pratim Das stated, “The survivor, a 14-year-old girl who is speech and hearing impaired, was assaulted inside an autorickshaw.” Islam Uddin, Monir Uddin, Dilawar Hussain, and the minor were arrested and charged under the POCSO Act. The minor Muslim accused was brought before a Juvenile Justice Board and sent to a shelter home, while the three adults were produced before a local court and remanded to police custody for three days.

Why it is Hate Crime ?

In this case, a minor Hindu girl with hearing and speech disabilities was abducted and gang-raped by Muslim men. This could potentially be a crime motivated by religious profiling, as in several cases, Muslim perpetrators have targeted Hindu women and minor girls due to religious animosity towards Hindus and their faith. Hindu women and girls are particularly vulnerable to crimes such as rape and sexual assault at the hands of Muslim men. However, in this case, it is also possible that the crime was opportunistic, with the victim targeted primarily because she was accessible and had hearing and speech disabilities, making her more vulnerable. Some may argue that the Muslim perpetrators specifically targeting a Hindu girl could also suggest religious profiling, but this remains highly speculative. At present, there is no clear evidence indicating religious motivations behind the crime, and neither the victim nor her family members provided any statements suggesting a religious motive. For this reason, the case has been added to the 'Undecided' database. If any further information emerges indicating a religious motivation behind the crime, it will be reclassified and included in the hate crime database.
