Case Summary

In Kushinagar, Uttar Pradesh, a minor Hindu girl was raped and forcibly converted by a Muslim man in a village under the jurisdiction of Nebua Naurangia police station. According to Superintendent of Police Santosh Kumar Mishra, Ansari had entrapped the Hindu girl while working in Saudi Arabia. He maintained regular communication with her, sending money and a mobile phone. Despite the family's efforts to stop this contact, the girl remained in touch with him. After returning to Bharat a few days before the incident, Ansari intensified contact with the girl, converted her to Islam, and prepared to escape to Nepal. The girl’s mother immediately informed the police upon learning of the situation. Within 24 hours, law enforcement located the girl and arrested Ansari. The investigation confirmed that he had forged official documents by changing her name and obtaining an Aadhaar card with the new identity. During interrogation, Ansari stated that he had recently returned from Saudi Arabia and intended to settle in Nepal. Police arrested Naushad Ansari as he attempted to flee to Nepal with the teenager. Ansari had illegally changed the girl’s name to Noor Jehan and obtained an Aadhaar card under this false identity. Following the registration of the case, he was taken into custody, produced before the court, and remanded to jail. Police initiated an investigation into his contacts in Nepal and are examining his mobile phone call records. The perpetrator was booked under Sections 137(2), 87, 64, 340(2), and 336(3) of the Bharatiya Nyaya Sanhita (BNS), along with relevant provisions of the Protection of Children from Sexual Offences (POCSO) Act and the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021.

Why it is Hate Crime ?

This case has been added to the tracker under the primary category: Predatory proselytisation. The subcategory under this is: Proselytisation by grooming, brainwashing, manipulation or subtle indoctrination. The first tertiary category under this is: Conversion of minor, and the second tertiary category is: Rape and sexual assault/harassment. Religious brainwashing essentially means the often subtle and forcible indoctrination to induce someone to give up their religious beliefs to accept contrasting, regimented ideas. Religious grooming or brainwashing also involves propaganda and manipulation. It involves the systematic effort, driven by religious malice and indoctrination, to persuade “non-believers’ to accept allegiance, command, or doctrine to and of a contrasting faith. Cases of such grooming or brainwashing are far more nuanced than direct threats, coercion, inducement and violence. In such cases, it is often seen that there is repeated, subtle and continual manipulation of the victim to induce disaffection towards their own faith and acceptance of the contrasting faith of the perpetrator. While subtle indoctrination is widely acknowledged as predatory, an element which is often understated in such conversions or the attempts of such conversion is the role of loyalty and trust which might develop between the perpetrator and the victim. Fiduciary relationships are often abused to affect such religious conversion. For example, an educator transmitting religious doctrine of a competing faith to a Hindu student. The Hindu student is likely to accept what the teacher is transmitting owing to existence of the fiduciary relationship. The exploitation of the fiduciary relationship to religiously indoctrinate victims would also be included in this category. Since the underlying animosity towards the victim’s faith forms the basis of predatory proselytisation, such cases are considered religiously motivated hate crimes. The case in Kushinagar, wherein a minor Hindu girl was subjected to sexual assault and subsequently converted, exemplifies the grave issue of predatory proselytisation. The perpetrator, Naushad Ansari, engaged in a sustained pattern of calculated inducement, providing gifts and maintaining contact while residing abroad, thereby establishing a deceptive influence over the impressionable teenager. His actions, including the change of her name to Noor Jehan and the procurement of an illicit Aadhaar card, illustrate a methodical attempt to assimilate the minor into a new religious framework against her will and that of her family. The core motivation in this case was not merely sexual or personal but religious; thus, his actions were an effort driven by contempt for the victim's Hindu faith and culture. It is further important to note here that the victim was a minor, which means the element of consent and genuine change of conscience was missing ab initio. Minors, due to their young age and lack of maturity, are particularly vulnerable to manipulation and coercion. They may not have the ability to fully understand the implications of converting to another religion, and the Muslim perpetrator purposely targeted and exploited this vulnerability of the victim. Since this case exemplifies the use of coercion and manipulation to achieve religious conversion, it is a blatant act of religious hate, which is why it has been documented here in the hate tracker. Disclaimer: It is important to clarify that none of the media sources covering this case have specified the exact date when the victim's ordeal began.
