Case Summary

In Ghongade Basti, Solapur, Maharashtra, a Hindu man and his brother were brutally attacked by a Muslim mob following a minor road dispute. The incident quickly escalated into targeted communal violence against Hindus, with a large group of Muslims targeting members of the Hindu community in the area. This further led to a situation of communal clash between the two communities. As per news reports, there were long-standing tensions between Hindus and Muslims in the area. On the day of the incident, the conflict began when Bipin Patil, son of former BJP councillor Suresh Patil, was standing near a car parked outside his house. At that time, local Muslim residents named Rauf Inamdar and his friend were passing by in a vehicle. Rauf loudly honked at Bipin and demanded that he leave space for him. This led to a verbal argument between Bipin and the Muslim youths over the loudness of the horn. This verbal altercation angered several bystanders, and a very heated exchange ensued between Riyaz and Bipin. Riyaz then escalated the situation even more by calling his relatives, and soon a large Muslim group arrived at the scene. This increased religious tension in the area. The Muslim mob then gathered in front of Patil’s house and began stone-pelting. Even Patil and other Hindu bystanders retaliated against the attacks by stone-pelting. The situation quickly escalated even before many could comprehend what was happening; five to six two-wheelers and an auto-rickshaw were damaged as a result of the violence. During the violence, Bipin and Sandeep, sons of Suresh Patil, sustained head injuries and significant bleeding. Even the Muslim perpetrators, namely, Riyaz, Saifan Suleman Pathan, Rashida Pathan, Rauf Inamdar, and Afan Shaikh, sustained injuries to their legs and arms, and they were admitted to a government hospital. Following the incident, the police were informed, and a case was registered at the Jodbhavi Peth police station. The police registered a case against several Muslim perpetrators namely, Sijan Kadir Mulla, Adnan Kadir Mulla, Akib Satar Mulla, Irfan Inamdar, Yusuf Inamdar, Badshah Inamdar, Ibrahim alias Ibya Inamdar, Amir Inamdar, Baba Nisar Shaikh, Ajju Shaikh, Shahid Shaikh, Sohel Shaikh, Arbaaz Mulani, and 10 to 15 other Muslims.

This overwhelming and targeted response of the Muslim perpetrators showed that this was not simply a minor neighbourhood disagreement, but rather a deliberate assault on Hindu individuals. It is also important to consider that reports indicate long-standing religious tensions between Hindu and Muslim communities in the area, showcasing the religious and communal undertones behind this attack. While the initial spark of the violence was not religious, the way the violence unfolded, including the swift mobilisation of a Muslim mob, the clear targeting of Hindus, and the intensity of the attack, all glaringly demonstrate that the violence was directed at Hindus, rooted in religious animosity towards them. When a personal dispute draws in a large number of people from one community to attack another, it ceases to be an individual dispute or fight and rather becomes an instance of communal hatred and religiously motivated attack. This chain of events led to retaliation from the Hindu group, resulting in a full-blown communal clash and a breakdown of law and order in the area. The violence was targeted at the Hindu community, with the initial escalation and aggression coming from the Muslim perpetrators. The Hindus reacted only after being attacked. They were not the ones who initiated the attack. Moreover, previous incidents of communal tension in the area further support the view that the violence in this case was motivated by deep-seated communal hostility towards the Hindu community. Furthermore, the speed with which the Muslim group was mobilised particularly showcases that the attack was not spontaneous, but rather a premeditated and calculated effort to target the Hindu community. Such acts by Muslim perpetrators are a direct result of religious hatred towards Hindus.
