Muslim man poses as Hindus to trap, rape and blackmail a Hindu minor, threatens her with Shraddha Walker fate if she refuses to covert to Islam
Case Summary
In Hapur, Uttar Pradesh, Ali Khan, lured a minor girl studying in Class 11 into a love trap by pretending to be Aman. Following this, he blackmailed the girl for six months after recording her objectionable videos when she was intoxicated. He kept sexually assaulting her by blackmailing her with her private videos. Ali Khan also put pressure on the victim to convert to Islam and physically attacked her when she refused. When the girl learned that Aman’s real name was Ali Khan, she narrated the ordeal to her family. Accused Ali Khan kidnapped the girl on January 23 while she was on her way to school and raped her again. The accused also used casteist slurs against the victim. He threatened to cut the girl into pieces like Shraddha Walkar if she refused conversion. On February 3, a case was registered on the basis of the complaint lodged by the victim’s mother at the Gadhmukteshwar police station and the accused was arrested.
Why it is Hate Crime ?
When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. What gives this case a distinct religious angle is that the Muslim perpetrator actively hid his religion and pretended to be a Hindu to trap the Hindu victim. Further, he threatened her with death if she refused to convert to Islam. The religious motive of the crime is evident from the fact that the Muslim perpetrator hid his true identity to trap the Hindu victim, He targeted the victim specifically owing to her religious identity and after that, tried to forcefully change her religious identity to Islam pointing towards a crime with his motivations being driven by religious hate.
