Case Summary

A Hindu girl, mentally challenged and orphaned, was raped by Rafiqul Islam, a Muslim construction worker from Chapar, Dhubri. This indicent happened in the Patharghat area of Kokrajhar district, Assam, on 10 January 2026. The victim was alone when Islam lured her into a room at a road construction site and sexually assaulted her. The incident came to light after she narrated what had happened to a relative, who alerted local residents. They went to the labour camp, identified Islam, and confronted him before the police arrived. Order was restored, and Islam was taken into custody. A case was registered at Kokrajhar Police Station under relevant sections of the Bharatiya Nyaya Sanhita. The victim’s statement was recorded, and medical and legal procedures were initiated. Later the same day, hundreds of residents, including women, gathered outside Kokrajhar Sadar Police Station to protest. Demonstrators blocked the Kokrajhar–Bilasipara road, raised slogans demanding justice and exemplary punishment, and chanted “Go back Bangladeshis,” disrupting normal life. Tensions continued the following day, prompting the Kokrajhar District Committee of the Vishwa Hindu Parishad to call a twelve-hour bandh from 6:00 a.m. Markets, shops, educational institutions, private offices, and public transport came to a near standstill. Additional security forces were deployed to sensitive areas, and the district administration imposed prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, to prevent escalation of violence. Authorities convened a peace meeting at the Deputy Commissioner’s office, attended by Senior Superintendent of Police Akshat Garg, circle officers, district officials, political and social representatives, student bodies, and local residents. They announced the formation of a Special Investigation Team (SIT), led by a Deputy Superintendent of Police, to investigate the rape case. Vulnerable areas were identified for the installation of CCTV cameras and additional streetlights to strengthen public safety. Authorities appealed to the public to maintain peace and communal harmony. On 11 January, while being produced in court, Islam attempted to snatch a firearm from a constable and flee. Police opened fire to prevent the action, injuring him in the leg. Two constables were also hurt in the scuffle. Islam was initially admitted to Rabindra Nath Bordoloi Civil Hospital in Kokrajhar before being shifted to Kokrajhar Medical College and Hospital for advanced care. His condition was reported as stable. During the protests, an old mosque in Kokrajhar town was attacked and vandalised by a group of people who raised religious slogans while breaking windows and doors. A bus named Ma Sarada, returning from Balajan in Dhubri district to Sarlapara near the India-Bhutan border, was also attacked; several students aboard sustained injuries and were treated at nearby medical facilities. Authorities confirmed that investigations into both the crime and the public order incidents continued, with close monitoring of the situation in Kokrajhar.

Accordingly, despite strong circumstantial indicators and public perception of religious targeting, the case did not meet the evidentiary threshold required for definitive classification as a religiously motivated hate crime. It was therefore placed in the “Undecided” category. This designation preserved evidentiary discipline while allowing for reclassification should credible proof of religious motivation emerge.
