Muslim man rapes minor Hindu girl, converts her to Islam, then throws her in front of a moving train

Case Summary
In Bareilly, Uttar Pradesh, a Muslim youth identified as Fariyad raped a Hindu minor after converting her to Islam and then murdered her by throwing her in front of a running train. The Hindu girl’s body, chopped into two parts, was found lying near the railway tracks in Bareilly’s Fatehganj Purvi village. The accused has been arrested. According to the FIR lodged, the 15-year-old Hindu girl, resident of Faridpur, was being harassed by a Muslim youth living nearby for the last seven months. The accused, who runs a barber shop in the area, had also been threatening to kill the Hindu minor. He used to threaten to kill her brother as well. The victim had also informed her parents that accused Fariyad had converted her to Islam forcefully. The family members of the victim said in the FIR that the minor had left her house on May 8 for her college studies when she was abducted, raped and pushed in front of a moving train. A case has been registered against the complainant under various sections including murder, rape, POCSO and forced religious conversion.
Why it is Hate Crime ?
When there is pressure, threat or coercion employed upon the Hindu victim to convert to a different religion, in several cases, the victim refuses to succumb to the pressure/threats. Once the victim refuses, the perpetrator proceeds to murder the victim owing to his/her refusal to convert. In such cases, the pressure/threat/intimidation/coercion/violence itself is driven by animosity towards the victim’s Hindu faith. The murder then is another hate crime driven by the victim’s refusal to abandon his professed faith, Hinduism, and convert to the religion of the non-Hindu perpetrator. Since the victim’s faith is at the heart of the pressure to convert and the ensuing murder of the victim, such cases are considered religiously motivated hate crimes. In this case, the Hindu victim was a minor. She had told her parents before she was murdered that the Muslim man had been stalking her for 7 months and was also pressurising her to convert to Islam. Thereafter, she was murdered by the Muslim perpetrator. Since the case has an element of forced conversion to Islam, this case is being categorised as a hate crime.
