Shaqib poses as Sagar to woo minor Hindu girl, assaults, blackmails and attempts to rape her with his associates after identity revealed
Case Summary
In the Saharanpur district of Uttar Pradesh, a 17-year-old Hindu girl was trapped in a love affair by accused Mohammed Shaqib, who posed as a Hindu named Sagar. A video of the minor victim girl made rounds on social media in which she was heard saying that she had stopped talking to the accused after she came to know about his original identity. After that, the accused threatened to speak with her. One day, when she refused, he stormed into her house and abused her. He and four of his associates assaulted her and made an attempt to rape her. She ran away from the scene and shouted for help. Shaqib continued to blackmail her with her private photographs. He even made death threats if his sexual desires remained unfulfilled. The victim later filed a police complaint.
Why it is Hate Crime ?
Firstly, the religious motive of the Muslim perpetrator becomes apparent from the fact that he actively hid his religious identity to deceive the Hindu victim and once the victim fell into his trap, he tried to sexually exploit her. When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime.
