Case Summary

Hindus of India were targeted with violent threats of forced Islamisation of India by Pakistan's Islamic terrorist organisation Lashkar-e-Taiba (LeT). The accused threatened the 'Ghazwa-e-Hind' war against India. Ghazwa-e-Hind is an Islamic fantasy that refers to the complete conquest of India by invading Islamic forces. This term has been used by Pakistani terrorists and Islamic zealots against India for decades. The concept of Ghazwa-e-Hind is rooted in several works of Islamic literature named Hadiths. The doctrine predicts an onslaught upon the citizens of India by Islamist forces and their takeover of them. The doctrine prophesies a pitched battle between Hindus and Muslims before the supposed 'day of judgement' (qayamat), resulting in a decisive victory of Muslims over Hindu India. A video of the LeT organisation's terrorist, Abdul Rauf, surfaced on the internet, in which he expressed his desire to make Delhi his "bride." In the video, terrorist Abdul Rauf said, "Those who say that Kashmir is finished, dust on their faces. Insha Allah, not only Kashmir, Islam will spread to the entire world. Even today, the movement in Kashmir is the same as it was before. It is stronger than that. I have bigger news than this. Insha Allah, Makki Sahib used to say sitting here that we will make Delhi our bride. Ghazwa-e-Hind will happen." Terrorist Rauf also targeted the Indian military, stating that weapons like the Rafale, S-400, and drones were nothing compared to them. He said that the Indian Air Force would no longer dare to enter Pakistani airspace, as Pakistan is a nuclear power.

This separation was premised on the idea that Muslims owed loyalty primarily to the global Muslim community, the ummah, rather than the nation-state. In this context, the accused’s threats against India seek to galvanise Muslims worldwide against the so-called ‘kafir’ Hindus of India. His rhetoric aims to unite the Muslim ummah in a militant confrontation targeting India as a Hindu-majority country. This hostility towards India thus embodies a profound and systemic hatred of the Hindu community, as Muslim extremists view India as a Hindu collectivity; henceforth, any statement calling for Islamisation of India is anti-Hindu by default. Hence, this case epitomises intense anti-Hindu hate speech, the ideological roots of which have directly resulted in violence and discrimination against Hindus in both India and neighbouring Islamic countries like Pakistan and Bangladesh. The incitement to violence, the call for forced religious conversion, and the targeted violent threat against the Hindu community clearly reveal a deep-seated religious hatred that far transcends political rhetoric and constitutes a grave form of communal hate speech.
