Case Summary

A 15-year-old minor Hindu girl studying in Class 8 was lured and raped by 4 men in the Bilashipara town in Dhubri district on 27th November 2025. Moynal Haque, a married Muslim man from Ward 7 of Bilasipara town, whom the victim already knew, convinced her to accompany him to a nearby paddy field, telling her he would buy something for her from shops located behind the field. She went with him without suspicion. Once in the paddy field, Moynal Haque and three other men gang-raped her. On the morning of 28th November, residents found the minor girl in critical condition and rescued her. She was immediately taken to the local hospital. Medical examination confirmed that she had been raped by multiple persons. Her family filed an FIR at Bilasipara police station the same day. In her statement to the police, she identified Moynal Haque and three other individuals as the persons who raped her. Police have registered a case under Section 372/25 and 65(1) /70(2) / 127(2) / 137(2) / BNS R/W Sec 4 of the POCSO Act based on the complaint. As of one week after the incident, none of the four accused, including the main accused, Moynal Haque, had been arrested. Her family sought the intervention of the Chief Minister and demanded the death penalty for all the perpetrators. The Bilasipara chapter of the Vishva Hindu Parishad and Bajrang Dal have announced protests on the streets if the police do not arrest the culprits within a day.

Why it is Hate Crime ?

In this case, a 15-year-old Hindu girl was raped by the Muslim accused, Moynal Haque and three other men. This could potentially be a crime motivated by religious profiling, as it has been observed that in many cases, Muslim perpetrators target Hindu minor girls due to inherent animosity towards Hindus. Hindu girls are very vulnerable to crimes like rape and sexual assault at the hands of Muslim men. Since the accused already knew the victim, this further points towards religious profiling. However, it is also possible that the crime was one of opportunity, where the minor Hindu girl was simply accessible to the Muslim perpetrator. Meanwhile, it could also be argued that for a Muslim man, a Muslim girl would likely be more accessible than a Hindu girl. The fact that the perpetrator specifically targeted a Hindu girl could suggest religious bias. Moreover, the victim was a minor at the time of the incident, thus making any supposed "consent" given for a relationship from her side legally invalid under the Protection of Children from Sexual Offences (POCSO) Act. POCSO is a strict liability law, which means that the intention of the accused or the willingness of the minor is not taken into account when determining culpability. The underlying reason is that children are not considered mentally or emotionally developed enough to make mature decisions about relationships or elopement, which makes them highly vulnerable to manipulation and exploitation. Nevertheless, the case details currently provide no clear indication of religious motivation behind the crime. Furthermore, neither the victim nor her parents made any statements suggesting a religious motive behind the crime. For this reason, the case has been added to the 'Undecided' database. If further information emerges that points towards a religious motivation behind this crime, it would then be reclassified and included in the hate crime database of the Hinduphobia Tracker. Disclaimer- While this tracker acknowledges that four individuals have been named as accused in this case, for documentation purposes, the religion of the perpetrators has been recorded as Muslim since the primary accused, Moynal Haque, is confirmed to be Muslim. The religious identity of the other three men has not been independently verified at the time of documentation. However, given that they were also complicit in the rape of the Hindu victim, the case is recorded under a single perpetrator religion for consistency in categorisation. This approach ensures clarity in data representation without overlooking the involvement of other accused individuals.
