Hindu man lured into relationship, financially exploited and coerced into nikah by Muslim girl along with her family
Case Summary
In Bareilly, Uttar Pradesh, a Hindu youth named Kushal Yadav was lured, financially exploited and coerced into nikah (Islamic marriage) by a Muslim girl and her family. According to the complaint filed by the victim's mother, Sushila Devi, the victim, a B.Sc. nursing student, came into contact with the Muslim girl during his internship at the Bithri Chainpur Community Health Centre. They began talking, and the Muslim girl gradually lured him into a relationship. She took him to Badaun to meet her family, where her father demanded two lakh rupees from him as college fees. Furthermore, her parents and her brother threatened the victim and forced him to convert to Islam and undergo a nikah with the girl. After the forced marriage, her family demanded another five lakh rupees, which the victim flatly refused, stating that the marriage was not legal and forced. Subsequently, Kushal began to keep his distance from the Muslim girl, prompting her to file a false rape case against him. Later, the Muslim family demanded ten lakh rupees, insisting that the money be paid in order for them to withdraw the rape case. The victim's mother collected audio and video recordings of these settlement demands and submitted them to senior officials. Based on the complaint, the Bithri Chainpur police registered a case against the Muslim girl, her father, her mother, and her brother for extortion and criminal breach of trust. During the investigation of the earlier rape case, the police found that the accusations of kidnapping and sexual assault were not true, and concluded that both the victim and the Muslim girl had been in a consensual relationship. However, the police also stated that the marriage of the Hindu man and the Muslim girl happened in a legal manner. As of the date of writing this report, the police investigation is ongoing.
Why it is Hate Crime ?
This case has been added to the tracker under the primary category of - Men attacked for being associated with non-Hindu women. Within it, the sub-category selected is - Forced conversion before marriage. In such cases, a non-Hindu woman is in a relationship with a Hindu man when the force/pressure against the Hindu man to convert his religion begins to manifest. The relationship in such cases is mostly consensual and the religious identity of the perpetrator is known to the Hindu man in the relationship, however, at some point during the relationship, the non-Hindu woman starts to force/pressure the victim to convert his religion and give up his Hindu identity. In such cases, the methods used to force/pressure the victim to convert his religion often revolve around forcing/pressurizing the man to involuntarily consume beef, forced circumcision, forcing/pressurizing to read the Kalma or even pressurizing the victim to do ‘Nikah’, which is marriage under Islamic law, with a prerequisite being conversion to Islam. Cases where the Hindu man consensually converts to Islam in a relationship will be left out of the hate crime database, even though it could be argued in several cases that the conversion was a result of religious brainwashing. This case was a clear example of a hate crime committed against a Hindu man solely because of his religious identity. The victim was lured into a relationship, financially exploited, and threatened to undergo Nikah by the Muslim girl and her family. Even though the early phase of the relationship was consensual, the victim was threatened and coerced into undergoing Nikah, making it a religiously motivated hate crime. The fact that the Muslim girl filed a fake rape case against the victim proves that it was not a genuine relationship; instead, she lured him for religious conversion and financial exploitation. Such coercion exposed a deep hostility towards Kushal because of his Hindu faith. In the Islamic faith, conversion of the non-Muslim partner is seen as a prerequisite for Nikah, and in such cases where the Muslim perpetrator pressures the victim for Nikah, there is also simultaneous pressure for religious conversion. Thus, when the accused pressured him for Nikah, they were also pressuring him to convert to Islam. Because of the ingrained element of religious supremacy in Islam, the perpetrator's family believes that such interfaith relationships diminish the family’s ‘honour’, thus Hindu partners are often pressured for conversion. Pressuring a Hindu individual to discard his religious faith and embrace another is a direct attack on his religious identity and dignity. It is not a matter of personal choice; it is coercion rooted in hostility towards the victim's Hindu identity. Such an attempt reflects religious animosity because the act is not simply about personal differences but about erasing the victim’s Hindu faith, making it a religiously motivated crime. The Muslim family also attempted to financially exploit the victim, extorting lakhs of rupees from him. When the victim refused and began to keep his distance from them, they filed a false rape case against him, which the police later found out to be false. Such threats and fake cases were meant to subjugate the victim, forcing him to submit to their demands. It was systematic, targeted, and rooted in religious animosity. Such actions stem from inherent hostility towards the victim's professed faith since Abrahamic faiths believe that any non-adherent to the faith is subject to being dehumanised till they convert. Such acts were not merely personal crimes; they were rooted in a desire to dominate and erase the religious identity of the victim. Since such predatory actions stem from doctrinal animosity towards the Hindu faith and its adherents, this case is being documented as a religiously motivated hate crime. It is important to state that even though the police stated that the couple had married legally, based on a preliminary investigation. However, the fact that the police termed the marriage “legal” did not negate the coercive circumstances under which the victim was forced into the nikah. A marriage can be legally recognised yet still be the result of pressure, intimidation, threats, and financial exploitation. In this case, the victim stated that the marriage was forced, and the pattern of extortion and the subsequent false rape case reinforces the absence of free consent. Thus, the police statement addressed only the technical legality of the marriage, not whether the victim was forced or not. Given that this case meets the parameters of a religiously motivated crime, it is being added to the hate crime database of the Hinduphobia Tracker.
