Case Summary

In Ujjain, Madhya Pradesh, a Hindu woman was deceived into a relationship by a Muslim man who posed as a Hindu. The accused married the victim under false pretences. Later, he forced the victim to convert to Islam, wear a burqa, and undergo a nikah (Islamic marriage) with him. When the victim refused, she was physically assaulted. The Hindu woman, a resident of the Mahakal police station area, was lured into a romantic relationship by Qurbaan Shah, who posed as Rohit, to trap her. The victim worked as a cook, while Qurbaan lived next door. In 2016, he proposed to her by concealing his true identity. He then married her under false pretences and persuaded her to move to his home in the Jaisinghpura area, where his family also lived. His family, consisting of his mother, father, and brother, also pretended to be Hindus. During this period, Qurbaan sexually exploited the woman, and she gave birth to a daughter. In 2021, the woman began to feel suspicious when she noticed an increasing number of Muslims visiting Rohit’s house. When she confronted him, he revealed his true identity as Qurbaan Shah. After his real identity was exposed, Qurbaan forced the woman to convert to Islam, wear a burqa, and do a nikah with him. When she refused to comply with his demands, she was subjected to verbal abuse, physical assault, and was thrown out of the house. Distressed by these events, the Hindu woman went to the Mahakal police and filed a complaint against the accused. The police registered a case under sections 296, 115(2), and 351(2) of the BNS, as well as sections 3 and 5 of the Madhya Pradesh Freedom of Religion Act.
