Case Summary
A Taxi driver named Haji Muhammad has been booked under the POCSO act for sexually harassing a minor Dalit girl in Rajasthan whom he used to drive to school. The family of the victim, residing in Pali, Rajasthan, had arranged for a taxi to transport their minor daughter to school. The 12-year-old girl used to travel alone in this taxi. The incident came to light when the girl told her mother that the 35-year-old Taxi driver uncle indulged in bad touch. The victim stated that he used to ask her to sit in the front seat of the car and would then inappropriately touch her below the waist. Haji also used to ask her to touch his body and tell her that she should come to him when she grows up. He used to lure the victim by promising her a taxi ride. Additionally, he had threatened the minor not to tell anything to her parents, otherwise he would kill them. This ordeal went on for a month before the minor victim confessed to her family. After the family lodged a police complaint, a case was registered against Haji Muhammad under many sections including POCSO and SC/ST Act. The minor underwent a medical examination. However, Haji Muhammad has been absconding since the case was filed.
Why it is Hate Crime ?
Since the victim in this case is a minor, there is a strong suspicion of grooming involved. Grooming is a phenomenon where Muslim men specifically target minor non-Muslim girls for sexual exploitation, abuse and rape. However, since there is no specific evidence of pattern of victimisation of Hindu minors by the perpetrator and no indication from the parents of the minor that she was targeted for her religious identity, this case is being categorised as 'undecided'.
