Case Summary

In Fatehpur, Uttar Pradesh, a controversy arose at Bahua Junior High School Dasoli in the Lalauli Thana area, following obscene pictures and slogans written by students of a particular community on school walls. The issue began when Muslim students drew indecent images and wrote abusive words on the walls of Bahua Primary School. Girl students complained to primary school principal Shashi Kumar Kashyap, who erased the writing and reprimanded the students. However, the next day, similar incidents occurred. Kashyap reported the matter to the police, which led to opposition from junior high school principal Gayasuddin Khan. Khan reportedly defended the students and instead assaulted some of the female students. When the families of the affected students learned of the incident, they protested, joined by villagers and Hindu organizations demanding justice. District Magistrate Ravinder Singh ordered an investigation after receiving complaints. Basic Shiksha Adhikari Bharti Tripathi and the police visited the school, and after a three-hour investigation, Khan was taken into custody. A case was filed against Khan, three named individuals, and one unidentified person under relevant sections based on Kashyap’s complaint. Superintendent of Police Dhawal Jaiswal confirmed the arrest of the junior high school principal and stated that legal action was ongoing. It was revealed that Khan had a history of misconduct and had been suspended earlier following complaints. After reinstatement, he was transferred to a different school.

Why it is Hate Crime ?

This case has been added to the database under the category- Attack not resulting in death. Under this, the sub-category selected is- Attacked for opposing radicals or trying to save victim. In several cases, Hindus are attacked for opposing religiously motivated crimes being committed against a fellow Hindu or simply for voicing an opinion opposing radical elements, who either have in the past or continue to persecute Hindus. In such cases, the initial attack against the victim, against which the Hindu was trying to defend the victim, would also need to be classified as a religiously motivated hate crime. Since the initial crime itself was religiously motivated and the subsequent crime of attempting to save the victim or speaking against the radical elements ends up inviting a violent attack, it would also be classified as a religiously motivated hate crime under this category. This case qualifies as a religiously motivated hate crime under the mentioned category due to the targeted actions against those who opposed provocative and inappropriate behaviour rooted in religious antagonism. The issue began when Muslim students defaced school property with obscene drawings and abusive slogans. The involvement of junior high school principal Gayasuddin Khan, who defended the perpetrators and assaulted female students who raised their concerns, highlights the religiously motivated hostility behind the incident. Khan’s actions appear to be an attempt to silence opposition to such radical conduct. This deliberate effort to intimidate and suppress dissent aligns with the broader pattern of religiously motivated hate crimes, where individuals who challenge radical actions are attacked to maintain a prejudiced agenda. Moreover, such arbitrary actions targeting Hindu girls were prejudicial and stemmed from deep-seated animosity and bias against Hindus. This underlying prejudice further underscores why this case is being classified as a religiously motivated hate crime.
