Hindu eunuch forced to convert to Islam by Muslim transgenders, assaulted when refused
Case Summary
In the Muzaffarnagar region of Uttar Pradesh, a case involving the forced conversion of a Dalit eunuch named Muskan to Islam emerged. She filed a police complaint against three other eunuchs, Preeti, Kaushar Ali, and Guddu, on November 24. Muskan suffered abuse for rejecting Islam, as she notified authorities in Nawala village, asserting her Hindu identity and adherence to Sanatan Dharma. Muslim transgenders, particularly the accused trio, had long been resentful of her religious practices. Despite her refusal, they pressured her for years to convert, resorting to torture when she resisted. On November 24, Muskan was attacked by the perpetrators and their associates in an attempted murder, prompting her to file a case.
Why it is Hate Crime ?
Harassment covers a wide range of behaviours of an offensive nature. It is commonly understood as behaviour that demeans, humiliates, and intimidates a person, including threats and coercion. Harassment and threats, in this case, find their root on discriminatory grounds which has the effect of nullifying a person’s rights or infringing upon his freedom to exercise his right specifically owing to the victim’s religious identity. Verbal and physical threats and psychological or physical harassment are often used against Hindu victims because they choose to practice their professed religion. Religious harassment also includes forced and involuntary conversions by harassment, threats or coercion. Coercion includes intimidatory tactics like force-feeding a Hindu victim beef to convert to another religion, forceful circumcision etc. In several cases documented, non-Hindu perpetrators or those who harbour specific animosity towards Hinduism, harass victims simply based on their religious identity. Such cases often also include harassment to ensure the Hindu victim abandons his/her professed religion and adopts the religion of the perpetrator. The details of this case reveal that the Muslim perpetrator, to alienate the Hindu victim from her professed faith inflicted torture on her. The victim testified that the accused were resentful of her professed faith, Hinduism and subjected her to physical abuse when she resisted their conversion demands.
