Case Summary

Gujarat Police raided a samosa shop in Vadodara, arresting six individuals, including Yusuf and Naeem Sheikh, for selling samosas stuffed with beef. The shop, known as 'Huseni Samosa' in the Chhipwad area, was operating without a license. Acting on information provided by local animal activist Neha Patel, who suspected the sale of beef-stuffed samosas, the police conducted the raid. Forensic tests confirmed the presence of beef in the samosa stuffing, leading to the arrest of the six individuals, including owners and employees. The accused operated from a facility with a deep freezer to store meat. While Yusuf Sheikh claimed to have joined his father's business, investigations revealed the absence of a valid license for the shop. Further, it was found that Hussaini Samosa was in a Muslim-dominated area, however, it was one of the largest raw samosa suppliers in the city of Vadodara, which would mean that the beef stuffed samosas were being consumed by several Hindus as well.

Why it is Hate Crime ?

Sanatan Dharma is not a religion of one book, which is to say that while it has religious scriptures that form the central tenets of the faith, there are several traditions followed through thousands of years, mostly passed from generation to generation orally. There are several such customs and traditions that are followed by various Hindus and Hindu sects. Defiling of these traditions and customs is a breach of an individual or group’s religious practices. Such practices can range from dietary restrictions like not eating non-vegetarian food for a certain period of the year, not eating non-vegetarian food at all, not eating beef since the cow is considered holy in Hinduism, the sanctity of religious customs followed in the house (like many ISCKON devotees), etc. Any malicious action leading to the breach of such traditions or defilement of these traditions owing to animosity towards the faith or for the sake of activism stems not only from the lack of faith in the religion itself but also from disregard for the faith of the devotees who follow the customs/traditions and implicit bias against the faith, the tradition itself. Since these specific traditions are central to the faith of the devotees of that specific sect of Hindus, any non-compliance with these traditional rules would be considered a religiously motivated hate crime. In this case, the Muslim samosa sellers were deceptively stuffing the samosas with cow meat. Firstly, cow slaughter itself is against the law in the state of Gujarat. Beyond that, Hussaini Samosa was supplying raw samosa to the entire city of Vadodara, which would mean that several Hindus, who don't consume beef as a matter of religious customs, consumed beef because of the malicious deception of the Muslim owners of the Samosa shop. Since defiling the customs of Hindus stems out of intrinsic animosity towards Hindus and their faith, this case is being classified as a religiously motivated hate crime.
