Minor Hindu girl sexually assaulted by Muslim man in Madhya Pradesh

Case Summary
In Indore, Madhya Pradesh, a nine-year-old minor Hindu girl was sexually assaulted by a Muslim man named Mushtaq Khan. According to news reports, the victim lived with her father and brother. Her mother lives separately from the rest of the family. The accused, Mushtaq, was an acquaintance of the victim's father and, therefore, a frequent visitor at the victim's residence. The father would leave for work, and the daughter would be home alone. On the day of the incident, the girl's brother had gone outside to play. Meanwhile, Mushtaq, on the pretext of getting snacks, came to the girl's home and sexually assaulted her. The girl started crying due to pain. Thereafter, Mushtaq panicked and fled from the spot. One day, the victim's father was leaving for work, and he advised the daughter not to go out and also not to let her brother go anywhere. Thereafter, he told the girl that he would meet Mushtaq. Hearing the name of the accused, the girl, out of fear, started crying and narrated her ordeal to her father. Thereafter, the father of the victim reached out to leaders of the Hindu organisations, who then caught hold of Mushtaq and handed him over to the police. The police immediately took him into custody and interrogated him. TI Virendra Kushwaha said that, "The FIR has been registered against the accused in the case. Further action is being taken on the basis of the girl's statement. The accused is being questioned in the case." Mushtaq was arrested, and various sections of the BNS and the POCSO Act were imposed on him. According to the police, the girl was sent for a medical examination. According to the Nav-Bharat report, after police interrogation, the accused was produced in the court and sent to jail in judicial custody.
Why it is Hate Crime ?
In this case, a minor Hindu girl was sexually assaulted by a Muslim man named Mushtaq Khan. This could potentially be a crime motivated by religious profiling, as it has been observed that in many cases, Muslim perpetrators target Hindu women and girls due to inherent animosity towards Hindus, particularly Hindu women. Hindu women and girls are very vulnerable to crimes like rape and sexual assault at the hands of Muslim men. However, due to the lack of solid evidence indicating a religious motive, the case is categorised as an 'Undecided Case'. In this instance, based on the available details, it is entirely possible that the crime was one of opportunity, where the minor Hindu girl was simply accessible to the Muslim perpetrator, Mushtaq. However, it could also be argued that for a Muslim perpetrator, a Muslim girl would likely be more accessible than a Hindu girl. The fact that the perpetrator specifically targeted the Hindu girl could suggest religious profiling of the victim. However, this remains speculative, as the case details provide no clear indication of religious motivations. For this reason, the case has been added to the 'Undecided' database. If further information emerges that hints towards a religiously motivated crime, then it would be reclassified and included under the Hate Crime database. Disclaimer: It is important to clarify that the report does not specify the exact date when the girl's ordeal began. Therefore, for documentation purposes, we have recorded the date based on when the incident was reported in the media.
