Case Summary

In a horrific act of terror in the Baisaran Valley of Pahalgam, Anantnag district, Jammu and Kashmir, Islamic terrorists systematically identified and targeted Hindu victims. The terrorists demanded names and religious identities, inspected ID cards, coerced tourists to recite the Kalma, and even forcibly pulled down their pants to check for circumcision—all to single out Hindus. Once identified, the Hindus were shot at point-blank range. The attack, carried out by Islamic terrorists of The Resistance Force, a proxy of the Pakistan-based terror group Lashkar-e-Taiba (LeT), claimed the lives of 24 Hindus and left 16 others critically injured. Following this incident, a Muslim youth named Aman, who runs a barber shop in Kheda village, justified the Pahalgam attack, where Islamic terrorists selectively targeted Hindu tourists. In the video, which went viral, Aman claimed that those killed in the terrorist attack deserved it. The video quickly spread across social media, drawing widespread outrage from the public. Enraged by the video, a crowd gathered outside Aman’s salon and confronted him over his remarks. The situation turned violent as the crowd physically assaulted him before handing him over to the police. Footage of the incident, including both Aman’s original statement and the public’s response, went viral on social media. Following the public outcry, the Hindu Jagran Manch submitted a formal complaint to the local police station, demanding strict action. The police registered a case and arrested Aman, son of Rahisuddin, from Mohalla Saddikpura. Circle Officer Anita Chauhan confirmed that legal proceedings had commenced and that the police were acting based on the contents of the viral video.

This incident qualifies as a hate crime because of the mocking of the death of innocent Hindus. By dismissing or mocking the persecution of Hindus, as deserved, the speech dehumanises the Hindu community and legitimises hostility towards them. This act of denial not only erases the trauma of Hindus but also encourages future prejudice and violence by suggesting that such actions were justified or warranted. By undermining the legitimacy of Hindu persecution, this type of speech fosters an environment of hate, making it a hate crime.
