Hindu girl raped, private pictures leaked online for refusing conversion by a Muslim youth posing as Hindu
Case Summary
In Indorama, in the Pithampur police station area of Dhar district, Madhya Pradesh, a case came to light where a Muslim youth feigned his religious identity to trap a Hindu girl, only to later pressure her into converting to Islam. He threatened her and leaked her intimate photos online when she did not comply with his demands. According to reports, a Muslim youth named Shoaib befriended a Hindu girl through Instagram by using the Hindu name Ashish. After establishing trust and friendship, he pressured the victim to convert to Islam. Upon her protesting, Shoaib raped her under threats of death. Furthermore, he also made obscene videos and photos of the victim and circulated them on social media platforms, leading to public harassment and trauma for the victim. As of the date of this report, the police registered an FIR under various sections of the BNS for rape, the SC/ST Act, the Religious Freedom Act, and cybercrime. Shoaib was on the run, and efforts were being made to apprehend him.
Why it is Hate Crime ?
This case has been added to the tracker under the primary category of- Crimes against women in relationships and other sexual crimes, with sub-category being selected as - Man pretends to be Hindu, and the tertiary category being- Name changed. When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. The second sub-category selected here is- Rape for refusal to convert. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman faces pressure/threats/violence to convert and change her religious identity by the non-Hindu man. Such relationships may be consensual with the religious identity of the non-Hindu man known to the victim. Somewhere along the relationship, the non-Hindu man starts pressuring the Hindu woman to convert. In some of these cases, the association could be non-consensual as well, or the religious identity of the non-Muslim man could be previously unknown to the Hindu victim. As the case may be, in such cases, the non-Hindu man forces himself sexually on the Hindu woman when she refuses his advances and pressures to convert her religion. The rape of the woman is often seen as either a punishment for the woman refusing to convert. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes. In this instance, the Muslim perpetrator concealed his religious identity to deceive and trap the Hindu girl, demonstrating clear bias and malicious intent toward her religion. This act of deception severely compromised the girl’s ability to make informed decisions regarding her relationship and religious choices. Furthermore, once his true identity was revealed, his attempt to pressure her into converting to Islam and punishing her for refusing to comply with his conversion demands constituted a direct assault on her religious freedom. Such coercion infringes upon her right to practice her faith and maintain her religious identity. Forced conversion, whether through threats, manipulation, or emotional pressure, is a grave violation of religious rights and can be viewed as an effort to erase her cultural and religious identity. The deception of making a Hindu woman believe he shared her faith, only to later demand she abandon her religion, indicates a deep-seated contempt for her religious beliefs. This behaviour exemplifies an attempt to subjugate her faith, reinforcing notions of religious superiority and intolerance. The intent to change her religious identity through deceit and pressure underscores the underlying religious hatred and bigotry, driven by animosity toward the victim's religion, and this is why this incident has been added to the 'Hate Crime' database in the tracker.
