Why it is Hate Crime ?

This case has been added to the tracker under the primary category- Predatory proselytisation. Under this, the sub-category selected is- Proselytisation by grooming, brainwashing, manipulation or subtle indoctrination, and within it, the tertiary categories selected are- Conversion of minor and Family claims grooming. Religious brainwashing essentially means the often subtle and forcible indoctrination to induce someone to give up their religious beliefs to accept contrasting regimented ideas. Religious grooming or brainwashing also involves propaganda and manipulation. It involves the systematic effort, driven by religious malice and indoctrination, to persuade “non-believers’ to accept allegiance, command, or doctrine to and of a contrasting faith. Cases of such grooming or brainwashing are far more nuanced than direct threats, coercion, inducement and violence. In such cases, it is often seen that there is repeated, subtle and continual manipulation of the victim to induce disaffection towards their own faith and acceptance of the contrasting faith of the perpetrator. While subtle indoctrination is widely acknowledged as predatory, an element which is often understated in such conversions or the attempts of such conversion is the role of loyalty and trust which might develop between the perpetrator and the victim. Fiduciary relationships are often abused to affect such religious conversion. For example, an educator transmitting religious doctrine of a competing faith to a Hindu student. The Hindu student is likely to accept what the teacher is transmitting owing to existence of the fiduciary relationship. The exploitation of the fiduciary relationship to religiously indoctrinate victims would also be included in this category. Since the underlying animosity towards the victim’s faith forms the basis of predatory proselytisation, such cases are considered religiously motivated hate crimes. This case exemplifies a deeply troubling pattern in which minors are deliberately targeted due to their psychological and emotional vulnerability, with the intent of religious conversion. When a minor is involved, the absence of legal and informed consent becomes a critical factor. Children and adolescents are still undergoing cognitive development and are far more impressionable, making them particularly susceptible to emotional manipulation, coercion, and psychological grooming. This case, as reported by the victim’s brother, Lavlesh Pal, reflects these elements. He stated that his minor sister was abducted by Mohammad Asad with the assistance of Masook Ahmed and Pappu Danger. The clear allegation is that the girl was taken away with the intent to forcibly convert her and conduct a religious marriage (nikah), which indicates a planned act of proselytisation targeting someone incapable of understanding or consenting to such a life-altering decision. Such acts are not merely criminal in nature; they are ideologically charged, revealing religious prejudice and a calculated intent to alter the religious identity of a minor without her volition. The use of grooming, where trust is built only to exploit, is an insidious method that exploits the child’s naivety and dependence. In this context, the testimony of the family, especially that of a close relative like the brother, holds considerable weight. Such actions go beyond personal or individual offences and represent a systemic effort to undermine and erase the religious identity of Hindu minors by coercive means. When a victim is chosen specifically because of her Hindu background, and efforts are made to isolate her from her family and convert her faith, it reflects religious animosity and hostility. These acts not only violate the rights and safety of the individual but also instil fear within the broader community. Hence, the combination of grooming, forced conversion, and targeting based on religion places this incident firmly within the scope of a hate crime.
