Case Summary

In Kanpur Dehat, Uttar Pradesh, Hindus were attacked by Muslims after objecting to a Muslim man creating a disturbance during the celebrations of Independence Day. This incident resulted in intense communal tensions between the Hindu and Muslim communities. According to media reports, the attack occurred during Independence Day celebrations in the Mangalpur police station area. At the Vidyarthi Library on Hisanwa Road in Sandalpur town, Vishal Pal, a resident of Bichiyapur, stated that the library had organised an Independence Day event since morning. During this, Danish, a Muslim resident of Sandalpur who also studied at the library, disrupted the flag hoisting and prevented the national anthem from being played. Vishal further stated that the national flag was torn by the Muslim accused, Danish. When the Hindus present there protested, Danish summoned his Muslim accomplices, namely, Zafar Ali, Jasim, Ramzan, Shakeel, and seven to eight unidentified individuals. The accomplices of Danish arrived at the scene. They were armed with sticks and clubs. They began to violently assault Hindus present there. This led to even Vishal getting injured. This incident heightened tensions between Hindus and Muslims in the area. After news of the dispute spread, members of the Vishva Hindu Parishad arrived at the police station in large numbers, informing the police about the incident. When no meaningful action was taken, many of the Hindus sat on the ground and began a protest, demanding measures against the Muslim perpetrators. The police attempted to pacify the protestors, and the sit-in concluded only after the police assured action would be taken. Inspector Dhirendra Singh, in charge of Mangalpur Police Station, stated that the police responded promptly to the dispute, launched an investigation, and received a formal complaint from Vishal.

Why it is Hate Crime ?

This case has been added to the tracker under the primary category- Attack not resulting in death. Within this, the subcategory selected is- Attacked for opposing radicals or trying to save the victim. In several cases, Hindus are attacked for opposing religiously motivated crimes being committed against a fellow Hindu or simply for voicing an opinion opposing radical elements, who either have in the past or continue to persecute Hindus. In such cases, the initial attack against the victim, against which the Hindu was trying to defend the victim, would also need to be classified as a religiously motivated hate crime. Since the initial crime itself was religiously motivated and the subsequent crime of attempting to save the victim or speaking against the radical elements ends up inviting a violent attack, it would also be classified as a religiously motivated hate crime under this category. The other subcategory selected is- Communal clash/Attack. Communal clash is a form of collective violence that involves clashes between groups belonging to different religious identities. For a communal clash between Hindus and non-Hindus to qualify as a religiously motivated hate crime, the trigger of the violence itself would have to be anti-Hindu in essence. For example, if there is a Hindu religious procession that comes under attack from a non-Hindu mob and after the initial attack, Hindus retaliate in self-defence, leading to a communal clash between the two religious communities. While at a later stage, both communities are involved in the clash/violence, the initial trigger of the violence was by the non-Hindu mob against the Hindus and therefore, it could safely be termed as an anti-Hindu violence. Further, the trigger would also have to be religiously motivated. In the cited example, the attack by the non-Hindu mob was against religious processions and therefore, can be concluded to be religiously motivated. In some cases, the trigger may be non-religious, however, it develops into religious violence against Hindus at a later stage. In such cases too, the foundational animosity towards Hindus becomes the motivating factor of the crime and therefore, it would be classified as a religiously motivated hate crime against Hindus under this category. This incident constituted a hate crime and a religiously motivated attack against Hindus. It is vital to clarify that, although the violence began with the Muslim perpetrator, Danish, disrupting the national anthem during the Independence Day programme and desecrating the Indian national flag, the underlying motive ran far deeper. In numerous instances, Muslims have perceived India as a Hindu collectivity and, as a result, perpetrated desecrations and caused harm to national symbols due to inherent animosity towards Hindus. This mentality is rooted in the concept of the Ummah, which prioritises Muslim brotherhood and regards the majority Hindu population as an enemy. Indeed, this notion of Islamic Ummah was central to the formation of Pakistan. The prevalence of this belief often means Muslims feel no attachment or patriotism towards India. Acts of desecration involving Indian national symbols stem from this ingrained hatred of Hindus and Hindu collectivity, India, thereby making it a religiously motivated offence. Secondly, when Hindu attendees objected to the desecration, they were subjected to brutal violence by the Muslims. Hindus were attacked purely for opposing the desecration of the national flag—a symbol which, in the eyes of the Muslim perpetrators, represents Hindu collectivity. The attack thus targeted both Hindus and the very idea of a united Hindu community, distinguishing it clearly as a religiously motivated assault. Such acts of violence demonstrate the depth of contempt and hatred the perpetrators hold towards Hindus. Thirdly, the attack escalated into communal tensions between Hindus and Muslims, as Muslim extremists launched violent assaults, injuring Vishal, the main complainant, and other Hindus at the scene. The intensity and brutality of the violence further underscored the profound religious animosity that motivated these actions. Accordingly, the nature of this incident satisfied all the criteria for a religiously motivated crime. Equally crucial is that the Muslim perpetrators quickly arrived armed with sticks and batons. This clearly indicated that the event was not a random or isolated attack, but a premeditated and well-coordinated assault against Hindus owing to their religious identity. The use of weapons revealed the intent and planning that lay behind the violence, evidencing that the attack specifically targeted the Hindu community. Such orchestrated aggression, directed at individuals because of their background and faith, elevates the incident to a religiously motivated hate crime against Hindus and their collective identity. Such violent attacks have clear communal undertones, motivated by extreme hatred and disdain for the Hindu community, and have therefore been added to the hate crime database. Disclaimer: Media reports stated that multiple Hindus were victimised in the attack by the Muslims. However, since there is no clear number of individuals who were attacked and the reports only specify Vishal. Therefore, for documentation purposes, we are recording the victim count as '1'. Disclaimer: The media reports stated that Danish, along with his accomplices—Zafar Ali, Jasim, Ramzan, Shakeel, and seven to eight unidentified individuals—attacked the Hindus, but do not provide an exact number. For documentation purposes, we have recorded the maximum count of 13 perpetrators in the database.
