Case Summary

In Chaksu, located in the Jaipur district of Rajasthan, a minor altercation escalated into a violent attack on Hindus by a Muslim group. The assailants barged into the houses of Hindus and assaulted the men and women present inside. They pelted stones at Hindu homes. The incident left six Hindus injured, two of whom suffered severe wounds and had to be hospitalised in Jaipur. According to media reports, the incident occurred in Daribon Mohalla, Ward Number 5, Chaksu. A group of Muslims was gathered in the area when some Hindus approached them and simply inquired about their presence. This seemingly harmless exchange angered the Muslim group, leading to an altercation. The Muslim youths then called for reinforcements, and the situation quickly spiraled out of control. A violent mob gathered, attacking Hindu homes with stones and forcefully entering their residences, assaulting both men and women. Upon receiving the information, the police arrived at the scene and identified four accused individuals: Salman Mirza alias Bablu, Mohammad Kaif, Monis Khan, and Haider Ali. Additionally, three minors were detained in connection with the attack. One accused individual managed to escape, prompting the police to launch an investigation to apprehend him.

Why it is Hate Crime ?

This case has been added to the tracker under the prime category of- Attack not resulting in death. Under this, the first sub-category selected is- Attacked for Hindu identity. In several cases, Hindus are attacked merely for their Hindu identity without any perceived provocation. A classic example of this category of religiously motivated hate crime is a murder in 2016. 7 ISIS terrorists were convicted for shooting a school principal in Kanpur because they got ‘triggered’ seeing the Kalava on his wrist and tilak that he had put. In this, the Hindu victim had offered no provocation except for his Hindu religious identity. The motivation for the murder was purely religious, driven by religious supremacy. Such cases where Hindus are targeted merely for their religious identity would be documented as a hate crime under this category. The second sub-category selected is- Communal clash/attack. Communal clash is a form of collective violence that involves clashes between groups belonging to different religious identities. For a communal clash between Hindus and non-Hindus to qualify as a religiously motivated hate crime, the trigger of the violence itself would have to be anti-Hindu in essence. For example, if there is a Hindu religious procession that comes under attack from a non-Hindu mob and after the initial attack, Hindus retaliate in self-defence, leading to a communal clash between the two religious communities. While at a later stage, both communities are involved in the clash/violence, the initial trigger of the violence was by the non-Hindu mob against the Hindus and therefore, it could safely be termed as an anti-Hindu violence. Further, the trigger would also have to be religiously motivated. In the cited example, the attack by the non-Hindu mob was against religious processions and therefore, can be concluded to be religiously motivated. In some cases, the trigger may be non-religious, however, it develops into religious violence against Hindus at a later stage. In such cases too, the foundational animosity towards Hindus becomes the motivating factor of the crime and therefore, it would be classified as a religiously motivated hate crime against Hindus under this category. While the initial dispute may not have been religious in nature, the way the violence unfolded strongly indicates a religiously motivated hate crime. What could have remained a minor altercation between individuals quickly escalated into a targeted attack on Hindus and their homes, highlighting a deliberate communal assault driven by religious animosity harboured by the Muslim group against Hindus in the area. Rather than keeping the conflict between those directly involved, the Muslim group escalated the situation by calling reinforcements, gathering a mob that deliberately targeted Hindu households. This act of selective aggression towards Hindus makes it evident that the violence was not an ordinary brawl but rooted in religious hostility. The mob’s actions further reinforce the communal nature of the attack, as they forcefully entered Hindu homes, physically assaulted both men and women, and pelted stones at their residences. Such indiscriminate targeting of Hindus based on their religious identity demonstrates that the perpetrators did not just retaliate against specific individuals but extended their violence to the entire Hindu community in the vicinity. This escalation from a minor scuffle to a large-scale communal attack underscores the pre-existing animosity and intolerance that fuelled the assault. The deliberate and selective nature of the violence against Hindus makes it clear that this was not merely an instance of local unrest but a religiously motivated hate crime. For these reasons, this case has been rightfully added to the tracker.
