Faizal Abbas pretends to be Hindu, forces minor victim to convert to Islam by blackmailing with intimate videos and rapes her
Case Summary
Faizal Syed Abbas of Bhopal, Madhya Pradesh, posed as Shaan Pandit to befriend a 16-year-old Dalit Hindu girl. The accused also got a fake Aadhaar made in the name of Shaan. The minor victim was taken to a hotel and raped. The accused took videos and pictures to threaten the victim to convert to Islam and wear a burqa and continued sexually assaulting her for three years. Following the victim's initial pregnancy, the accused went with her to Dr. M. Srivastava, who carried out the abortion. Then, the victim was given medication by the accused on two other occasions, both of which caused miscarriages. Bhopal police arrested the doctor who performed the abortion on the minor girl and sealed his clinic under section 313 of the IPC MTP Act for legal traits and illegal practices. Before the doctor's arrest, police arrested Faizal Syed Abbas based on a complaint filed at Ajak police station under sections 376 (Rape), 377 (Unnatural crimes), and the Religious Freedom Act.
Why it is Hate Crime ?
There are multiple threads of hate crime in the case. It is pertinent to understand here that when the victim is a minor, the ‘consent’ to convert or enter into a romantic relationship with an adult itself is redundant – addressed by POCSO. While every case of conversion of a minor and incidents of establishing a physical relationship with a minor by an adult is a crime, for the purpose of this database, a case would be considered a hate crime only if there is a distinct religious angle to the grooming. For example, in the UK, if a Hindu minor is targeted by Pakistani grooming gangs, it would be considered a hate crime because the victims are specifically targeted owing to their non-Muslim religious identity with the perpetrators being Muslim. In other cases, if a Hindu minor is brainwashed into entering a physical relationship with the non-Hindu adult perpetrator and the family alleges grooming/brainwashing of the minor to convert her religion, it would form a part of this database.
