Married Muslim man poses as a Hindu to trap Hindu student, rape her with his father, forces conversion

Case Summary
A 30-year-old banker and his 52-year-old father identified as Mohammed Akhlaq and Mohammed Moin, residents of Sangam Vihar, Delhi have been arrested for raping and pressuring a 23-year-old Hindu girl to convert to Islam for marriage. The victim is an MBBS student at a medical college in Noida and is originally from West Bengal. Akhlaq had met the victim during her coaching days on a social media site where he posed as a Hindu named Aditya Sharma. The two met face-to-face for the first time in 2021 and it was only then that she got to know about Akhlaq’s real identity. Moreover, the accused Akhlaq is already married and has two children. The victim was sexually abused, assaulted, threatened, and forced into conversion to Islam by the father-son duo. Both the accused were arrested.
Why it is Hate Crime ?
When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. In this case, a non-Hindu man concealed his religious identity and pretended to be a Hindu to lure a Hindu woman. The perpetrator along with his father inflicted violence on the victim to force her to convert to a different religion against her will. Further, the father and son duo raped her forcing her to convert to Islam. Since the religious motive of the crime is evident from the fact that the man pretended to be a Hindu to trap a Hindu woman and used violence for forced conversion, this case has been documented as a hate crime.
