Case Summary

In Varanasi, Uttar Pradesh, a Hindu woman was lured into a relationship by a Muslim man named Naseem, who posed as a Hindu man named Ajay Kumar. The accused deceived the victim and forcibly converted her to Islam, compelling her to undergo a Nikah, an Islamic marriage, with him. Simultaneously, the victim was raped and physically assaulted by the accused. According to media reports, the Hindu victim from the Mirzamurad Police Station area came into contact with the accused, who used a fake identity named Ajay Kumar, on Instagram. Naseem, posing as a Hindu, began communicating with her. Over time, their interaction grew closer, and on 29th August 2025, he absconded with the Hindu woman. The victim's mother subsequently filed a formal written complaint against him at the police station. The accused took her to an undisclosed location, where he pressured her to convert to Islam and, upon her refusal, physically assaulted her. He then forcibly conducted a nikah ceremony (Islamic marriage) with her. During this period, the accused repeatedly raped her, resulting in her becoming approximately one and a half months pregnant. Traumatised by these incidents, the victim approached the Mirzamurad Police Station to register a complaint against the accused. The Station House Officer (SHO) of Mirzamurad stated that the victim’s statement had been recorded and a medical examination was underway. The accused was being interrogated. Police confirmed that a case had been registered against Naseem under serious sections of the Bharatiya Nyaya Sanhita (BNS) related to rape, fraud, assault, and forced religious conversion. Subsequently, the accused Naseem was arrested by the police, and his interrogation commenced.

Why it is Hate Crime ?

This case is being added to the tracker under the primary category- Crimes against women in relationships and other sexual crimes. The subcategory selected is- Man pretends to be Hindu. The tertiary category selected is- Name Changed. When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. The other subcategory selected is- Forced conversion before marriage. Within this, the tertiary category selected is- Forced to do Nikah. In such cases, a non-Hindu man is in a relationship with a Hindu woman when the pressure to convert her religion begins to manifest. In such cases, typically, two patterns emerge. First, when the relationship is consensual, and the religious identity of the perpetrator is known to the Hindu woman in the relationship, however, at some point during the relationship, the non-Hindu man starts to force the victim to convert her religion and give up her Hindu religious identity. The second is when the woman gets into a marriage with the man pretending to share her faith. Later, when the truth is revealed, the man starts pressuring the woman to convert her religion and give up her religious identity. In both the situations, the methods used to force the victim to convert her religion often revolve around force-feeding beef, forcing her to wear hijab, forcing her to read the Kalma or even pressurizing the victim to do ‘Nikah’, which is marriage under Islamic law, with a prerequisite being conversion to Islam. Cases where a Hindu woman consensually converts to Islam in a relationship will be left out of the hate crime database, even though it could be argued in several cases that the conversion was a result of religious brainwashing. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman faces threats or assault after she refuses to convert and change her religious identity owing to pressure/force by the non-Hindu man. Such relationships may be consensual with the religious identity of the non-Hindu man known to the victim. Somewhere along the relationship, the non-Hindu man starts pressurizing the Hindu woman to convert to Islam and upon her refusal, assaults or threatens the victim. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes. Cases where the Hindu woman converts to Islam and does not file a complaint about the force or threat, are not considered a part of the hate tracker, even though, it may be argued that the woman was brainwashed or threatened to convert to Islam. The other subcategory selected is- Assault or threat upon refusal to convert. In this case, the Hindu woman was deliberately deceived into a relationship by a Muslim man who pretended to be Hindu. Following this, the victim was forcibly converted to Islam and compelled to marry the perpetrator. She was also physically assaulted and raped multiple times by the Muslim accused. First, the perpetrator’s deception, by posing as a Hindu, clearly reveals a deep bias and malicious intent against the victim’s religion. By concealing his true identity, the accused manipulated the Hindu woman’s trust, targeting her under false pretences. This was a calculated and premeditated effort to exploit the victim because of her religious background. Such actions violate her right to informed consent over whom she chooses to be with or marry, and they constitute a blatant attack on her religious beliefs. The accused’s deliberate concealment of his religious identity strongly highlights the religious motive behind this crime. Identity concealment here was not merely a personal deception but a tactic rooted in religious profiling and targeting. The accused knew that revealing his true Muslim identity would have led to rejection, so he chose to lie, demonstrating a clear religiously motivated intent. This deception is part of a broader pattern where Hindu women are specifically targeted by Muslim men using false identities, often to coerce or convert them. Such targeted victimisation exposes deep animosity not only to the individual but to Hinduism as a whole. Second, forcibly converting a Hindu woman and compelling her to enter a marriage under Islamic law constitutes a direct act of religious malice. Islamic law allows a Muslim man to marry a non-Muslim woman only if she first converts to Islam. The accused deliberately forced the victim’s conversion, confirming that his initial deception was a premeditated step designed to forcibly convert and marry her. This represents a deliberate effort to strip her of her Hindu faith and identity. Such actions stem from deep-rooted hatred towards the victim and her religion, clearly marking this as a hate crime motivated by religious hostility. When the victim resisted converting to Islam, she was physically assaulted by the accused. Violence was used as a tool to coerce and force her submission. Forced religious conversion through intimidation and physical abuse, as opposed to genuine belief, unequivocally constitutes a religiously motivated crime. Using violence and coercion to compel someone to change their faith is a clear example of a hate crime fuelled by anti-Hindu hostility. These forced conversions violate the victim’s religious autonomy, making this an unmistakable anti-Hindu crime. In addition to the forced conversion and marriage, the victim was raped repeatedly by the accused after her conversion. This act intensifies the religious motivation behind the crime. The rape was not solely for sexual gratification but a deliberate attempt to break the victim’s spirit and enforce submission. It symbolised Islamic domination over a Hindu woman, seeking to humiliate her and obliterate her religious identity. This sexual violence reinforces the hate crime dimension rooted in religious animosity. Given these facts, the case clearly meets the criteria of a religiously motivated hate crime committed against the Hindu woman because of her faith. Consequently, it has been added to the Hate Crime Database maintained by the Hinduphobia Tracker. Disclaimer: The Hinduphobia Tracker records the dates of incidents based on when the crime occurs rather than when it is reported by the media. However, in this particular case, the media reports have not specified the exact date when the victim's ordeal began. The only date mentioned is 29th August 2025, which is when the accused lured the victim away from her home. Therefore, this date is taken as the earliest indicative date of the incident for documentation purposes only, serving as an estimate of when the victim's ordeal started.
