Milkman Jabir attempts to rape 6-year-old Hindu girl by taking her inside a mosque

Case Summary
A case of attempted rape of a 6-year-old Hindu girl in Baghpat district of Uttar Pradesh was reported on September 19. The victim's father filed a complaint against an unknown person and demanded action. The girl was lured to the mosque by a Muslim milkman named Jabir, who then attempted to take her to the mosque and rape her. However, the accused threw the girl into the bushes, tearing her clothes and threatened to kill her and her family if she told anyone after the girl shouted and monkeys around attacked him. The accused then fled, leaving the girl crying. The girl reached her help following help from local people. The victim's father, who is a devotee of Lord Ram demanded strict action against the accused. The police registered a case under sections 74, 76, 115 (2), and 351 (2) of the Bharatiya Nyaya Samhita and the POCSO Act.
Why it is Hate Crime ?
In this case, there is a strong suspicion that the Muslim perpetrator chose to target the minor Hindu girl based on her Hindu religious identity. According to the facts of the case, the perpetrator was taking the minor Hindu girl inside a mosque to sexually assault her. It is possible that the perpetrator believed that a Hindu girl in the area of the mosque would not be recognised and owing to his inherent religious animosity, he believed that targeting the Hindu girl inside a mosque was acceptable. However, it is also true that from there is no conclusive evidence to suggest that religious animosity contributed towards the targeting of the Hindu girl. It is also possible that it was a crime of opportunity and the girl was being taken inside the mosque because he believed it would be a safe environment to commit the crime. There is also no testimony from the family of the minor to conclude that the girl was targeted because of her Hindu identity and no evidence to suggest that he would not have done the same with a Muslim girl-child. For that reason, this case is being added to the undecided database. If more information emerges, it would be added to the hate crime database.
