Case Summary

In Ghaziabad, Uttar Pradesh, a case emerged involving Talib Hasan, who posed as a Hindu named Ankit to deceive a Dalit widow. Over four years, he raped her, threatening to release explicit media he clandestinely recorded. The assaults occurred in an OYO room after intoxicating her. The incident transpired in the Crossing Republic police station area. Hasan, a salesman in Noida, extorted Rs 2 lakh from her and coerced abortions when she became pregnant. Learning his true identity, the victim filed an FIR on March 9th. She also said in her complaint that one day when the victim was travelling in an auto, this is after she started pressing him to tie the marital knot, Talib dragged her out of the vehicle and started physically assaulting her. The accused told to her that he was a Muslim and he was only using her. He also hurled casteist abuses at her.

Why it is Hate Crime ?

When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. What gives this case a distinct religious angle is that the Muslim perpetrator actively hid his religion and pretended to be a Hindu to ensnare the Hindu woman. He deceived the Hindu girl and then inflicted torture on the victim. She was forced to undergo an abortion multiple times by the accused, who later revealed to her that he was simply using her. The religious motive of the crime is evident from the fact that the perpetrator actively pretended to be a Hindu so that he could trap a Hindu woman. This case has been documented as a religious hate crime because the details clearly show that the offender had a bias against the Hindu faith and that the offence was performed in conjunction with that bias.
