Muslim man Chavez Ali pretends to be Hindu, traps Hindu woman, rapes her and extorts lakhs of rupees, then refuses to marry because she is Hindu
Case Summary
In Uttarakhand, Dehradun, Chavez Ali was accused of raping a woman by changing his name and trapping her in the web of love. Reportedly, Chavez also cheated the victim of lakhs of rupees and got her abortion done when she became pregnant. In the Patel Nagar police station area, a Hindu woman filed a complaint alleging that about one and a half years ago, a man named Chavez Ali, who introduced himself as Lucky, initiated contact with her. They began conversing over the phone, which eventually led to in-person meetings. Within a short period, Lucky proposed marriage to the woman. During this period, he raped her several times and made her consume abortion pills when she became pregnant twice. After some time, Lucky asked the victim for Rs 4 lakh to start a business before marriage. She managed to gather the money and gave it to him, including her savings. However, Chavez never returned the money. When the victim pressed for marriage, Chavez confessed his true identity as a Muslim from Saharanpur, Uttar Pradesh, stating he could not marry a Hindu. Feeling deceived, the victim filed a police complaint, alleging Chavez had defrauded multiple women in a similar manner. The police have registered an FIR and are searching for Chavez, who has fled.
Why it is Hate Crime ?
A hate crime is supposed to have taken place when the perpetrator intentionally targets an individual owing to his/her bias against a certain characteristic of that individual or his/her declared hatred towards that characteristic. A religious hate crime is one where the offense is committed against an individual or a group or an individual or a group of people are targeted specifically because of their religious identity. In cases where religiously motivated hate crimes against Hindu women in relationships are committed, it is seen that the perpetrator targets the victim specifically because of her religious identity of being a Hindu. When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. In this case, the Muslim perpetrator, Chavez Ali, pretended to be a Hindu man called Lucky to ensure that the Hindu woman agreed to be in a relationship with him. He then exploited her. After that, when the woman asked him to marry her, he confessed that his real religious identity was not Hindu but Muslim. The Muslim man also refused to marry her specifically for her religious identity, which makes it further evident that the name change was done with the intention of exploiting the woman specifically for her religious identity. It is evident that the name was changed by the perpetrator specifically to trap the victim owing to her religious identity and therefore, this is categorized as a religiously motivated hate crime.
