Case Summary

In Mirapur village, under the Kothi police station, a Muslim man named Naseem was arrested for posting an edited image of Ma Durga with an obscene and offensive song on his WhatsApp status. A case was filed against him for hurting religious sentiments by BJP MLA Dinesh Rawat of Barabanki, post which, Naseem was arrested.

There has also been overwhelming documentation where cow meat (beef) has been force-fed to Hindus to either forcefully convert them to Islam or denigrate their faith. Apart from cow worship, the Swastika – which holds deep religious significance for the Hindus – has also been misinterpreted and distorted to use as a slur against Hindus. Similarly, the worship of the Shivling has been used by supremacist ideologies and religions to denigrate Hindus owing to religious animosity. Such slurs and denigration stem out of inherent animosity and hate towards Hindus and their faith, therefore, it is categorised as hate speech targeted at Hindus specifically owing to their religious identity. In this instance, the accused Naseem altered an image of Ma Durga. This act can be seen as an iconoclastic representation, which involves the deliberate destruction or disrespect of religious icons or symbols. Such actions not only violate the sanctity associated with deities in Hinduism but also show a profound disrespect for the beliefs and values of millions of adherents. Further, the accused, paired it with offensive music. By doing this, the accused exhibited a clear disrespect and disregard for Hindu beliefs and practices. The act was not merely offensive but deliberately targeted a central aspect of Hindu worship, intending to provoke and insult Hindus who hold Ma Durga in high esteem. Such actions reflect a troubling intolerance toward the Hindus and their faith, leading to a classification as a religiously motivated hate crime.
