Case Summary

A Hindu woman was deceived, sexually exploited and pressured for religious conversion by a Muslim man named Aamir, who pretended to be Hindu. According to reports, the Hindu woman, who was married in 2014, went to Surat city in Gujarat about a year ago, in 2024, to work as a labourer. During this time, the victim came into contact with the accused, Aamir, who befriended her by introducing himself as a Hindu man named Anil. Following this, they remained in constant contact throughout. After a dispute with her husband, she returned to her parental home in Dhar, Madhya Pradesh. The accused followed her, deceived her and lured her with promises of marriage. Under this pretext, he took her away, raped her, and pressured her to convert to Islam. When she refused, he threatened to kill her. Concerned for her safety, her family lodged a missing persons report at the police station. Acting on the complaint, the police launched an investigation and swiftly arrested the accused and rescued the victim. A case was registered against Aamir Sheikh under sections of rape and the Madhya Pradesh Freedom of Religion Act, 2021.

It is not a matter of personal choice; it is coercion rooted in hostility towards the victim's Hindu identity. The purpose of this act was to destroy her religious identity. Such an attempt reflects religious animosity because the act is not simply about personal differences but about erasing the victim’s Hindu faith, making it a religiously motivated crime. Thirdly, the accused took her away and raped her, before pressuring her for conversion. Often in such cases, sexual violence serves a dual purpose: physical subjugation and religious humiliation. The intention is to break the victim down emotionally, physically, and spiritually so that she can be converted. This was not random violence; it was systematic, targeted, and rooted in religious animosity. Fourthly, when the victim resisted these demands, the accused threatened to kill her. These threats were not random acts of violence but were directly tied to her refusal to give up her Hindu faith. The use of violence or intimidation was intended to break her spirit and force compliance. The accused's willingness to go to extreme lengths to coerce conversion further demonstrates a clear pattern of hostility towards Hinduism and the Hindu community. Such actions stem from inherent hostility towards the victim's professed faith, since Abrahamic faiths believe that any non-adherent is subject to dehumanisation until they convert. Such acts were not merely personal crimes; they were rooted in a desire to dominate and erase the religious identity of the victim.
