Case Summary

In Mathura, Uttar Pradesh, a Hindu woman was pressured to convert to Islam before marriage by a Muslim man. The man, identified as Farukh, obtained intimate photographs and videos of the victim and used them to rape her repeatedly. Farukh, son of Babu Khan, was around 23 years old and hailed from Barari village in Mathura district, Uttar Pradesh, which falls under the jurisdiction of Refinery police station. He ran a noodles stall in Barari, where he met a woman from a neighbouring village. He drew her into a relationship by offering her noodles before obtaining intimate photographs and videos of her, which he later used to blackmail and sexually exploit her. He then subsequently pressured her to convert to Islam and perform Nikah with him. On Tuesday, 27 October 2026, Farukh took the woman to a hotel in Mathura, where members of the Hindu organisation Hindu Sabha intercepted them. After the incident, police registered a case at Kotwali police station under case number 750/2026. On Wednesday, 28 October 2026, at approximately 11 am, police arrested Farukh near the New Bus Stand on BSA Road in Mathura. Inspector Dinesh Kumar led the operation, accompanied by Head Constable Sanjeev Kumar and Constable Mange Ram. Circle Officer (Refinery) Praveen Tiwari provided details of the case. Police booked Farukh under Section 64(1) and Section 351(2) of the Bharatiya Nyaya Sanhita, Section 67 of the Information Technology Act, and Section 5(1) of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021. He was subsequently sent to jail in judicial custody as the legal proceedings continued.

Why it is Hate Crime ?

This incident has been added to the tracker under the primary category: Crimes against women in relationships and other sexual crimes. Under this, the selected subcategory is: Forced conversion before marriage, and the tertiary category is: Forced to do Nikah. In such cases, a non-Hindu man is in a relationship with a Hindu woman when the pressure to convert her religion begins to manifest. In such cases, typically, two patterns emerge. First, when the relationship is consensual and the religious identity of the perpetrator is known to the Hindu woman in the relationship, at some point during the relationship, the non-Hindu man starts to force the victim to convert her religion and give up her Hindu religious identity. The second is when the woman marries the man, who pretends to share her faith. Later, when the truth is revealed, the man starts pressuring the woman to convert her religion and give up her religious identity. In both situations, the methods used to force the victim to convert her religion often revolve around force-feeding beef, forcing her to wear hijab, forcing her to read the Kalma or even pressuring the victim to do ‘Nikah’, which is marriage under Islamic law, with a prerequisite being conversion to Islam. Cases where a Hindu woman consensually converts to Islam in a relationship will be left out of the hate crime database, even though it could be argued in several cases that the conversion was a result of religious brainwashing. The other subcategory is: Blackmailed to convert. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman is blackmailed to convert her religion, owing to her religious identity as a Hindu. Such relationships may be consensual, with the religious identity of the non-Hindu man known to the victim; however, there could be cases where the relationship is not consensual, and the non-Hindu man starts blackmailing a Hindu woman to convert her religion. In these cases, it is often seen that the Hindu woman is blackmailed with intimate photos and/or videos, threats of harm to her or her family, threats of violence, etc. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes. This case qualifies as a religiously motivated hate crime because the sexual violence was not an end in itself, but she was subsequently also pressured to abandon her faith and enter into a religiously motivated marriage. The religious dimension of the crime becomes apparent from the sequence of events described. Farukh raped the woman and used obscene photographs and videos to blackmail her, while also pressuring her to convert to Islam and marry him. This transformed the offences from sexual exploitation into religious coercion directed at a Hindu victim. The clearest religious marker in this case is the attempt to force the victim to abandon her Hindu identity and adopt another religion. The pressure on the Hindu woman to convert to Islam represented an attempt to make her abandon her existing religious identity and adopt a different faith against her wishes. Rather than respecting her right to retain her Hindu faith, the accused sought to make religious conversion a condition of the future he wanted with her. This made the conversion demand a direct infringement of her religious autonomy as a Hindu woman. The significance of this marker lay in the attempt to replace her existing religious affiliation with Islam through pressure rather than a freely made personal decision. The demand therefore went beyond a private disagreement or an ordinary relationship dispute: it concerned her freedom to remain Hindu without coercion. The fact that the Muslim youth demanded that the Hindu girl convert to Islam and perform Nikah (an Islamic marriage) is not just a personal request but a coercive attempt to strip her of her religious identity. The circumstances demonstrated that conversion and marriage were linked demands rather than entirely separate matters. This placed the woman in a situation in which the relationship she was being pressured to enter was associated with abandoning her Hindu faith and adopting Islam. The religious significance lay in the pressure placed on a Hindu woman to leave her faith as part of a proposed marriage, thereby threatening her ability to make independent decisions about both her religious affiliation and her marital future. By linking the two demands, the conduct raised concerns about coercion affecting both dimensions of her autonomy. The incident became even more egregious when the accused used her intimate pictures and videos to blackmail her. This act goes beyond mere criminal behaviour; it is a calculated and malicious attack on her religious identity. The use of blackmail to force her into sexual relations and then using that as leverage to force the victim into conversion is a clear demonstration of religious hate, as it targets the victim's religious beliefs and seeks to erase her identity. This case is a glaring example of how deep-seated intolerance can manifest in violent and coercive actions, with the ultimate goal of religious subjugation and domination. The deliberate nature of the deception and the subsequent attempt to force conversion highlights the extent of disdain the accused harboured for the victim's faith, making this a clear case of religiously motivated hate.
