Case Summary
In Basna, Mahasamund district, Chhattisgarh, a Hindu minor girl was sexually exploited, blackmailed and threatened with the circulation of obscene photographs and videos by a group of men, including two Muslim men and other co-accused. The accused also extorted approximately ₹4 lakh from the victim. Some reports also say that the victim was forced to convert to Islam by the principal accused, Umar Khan and Abdul Salam. The accused continuously threatened the minor with obscene photos and videos. They demanded money, threatening to make the photos and videos go viral on social media. As per the complaint by the victim, the blackmailing and exploitation began in 2021-22 and continued till 2026. According to information provided by the Mahajanpadnews report, a case was registered under FIR No. 572/26 for rape, threats to circulate obscene photographs and videos, blackmailing and the illegal extortion of approximately ₹4 lakh. The case was registered under Sections 64(1), 77, 79, 308(2), 351(2), 61, 65(1) and 70 of the Bharatiya Nyaya Sanhita (BNS), Sections 66E, 67 and 67A of the Information Technology Act, and Sections 4 and 6 of the Protection of Children from Sexual Offences (POCSO) Act. The case involved two main accused and five other co-accused: Umar Khan, Abdul Salam, Wakash Dayala, Anish Dayala, Thakur Ram Sahu, and two other minor accused. The police arrested all five major accused. After being produced in court, the court sent all five to jail in judicial custody. The other two minor accused were under 18 when the incidents began in 2021–22. According to the police, the exploitation continued after they attained adulthood, with the accused and their associates threatening to circulate obscene photographs and videos of the victim to blackmail her and extort money until 2026. On 13 October 2026, the Basna Police registered the case after the victim filed a complaint. During the investigation, the police seized the accused's mobile phones. On 14 October 2026, the police arrested five accused and sent them to judicial remand. On 18 October 2026, the police arrested the absconding accused, whose current age was stated to be 22. After his arrest, the police presented the accused before the court for remand. The police also took legal action against Anish Dayala, the father of the accused, for assisting his son in evading arrest. The police proceeded against him under Section 249(a) of the Bharatiya Nyaya Sanhita. At the time of writing this report, the Basna Police were continuing their investigation into the case.
Why it is Hate Crime ?
This case was placed in the Undecided database because, although the Hindu minor girl was raped, sexually exploited and blackmailed, the available material did not establish that the crimes were committed because of her Hindu religious identity. Social media posts stated that the principal accused, Umar Khan and Abdul Salam, had converted the victim to Islam. However, there was no testimony from the victim's family, no media reports at the time to confirm the conversion, and the FIR also did not mention religious conversion or invoke any related provisions. The Hinduphobia Tracker team also tried to contact the police to verify the claim but could not reach them. The sexual exploitation, blackmailing and extortion were serious criminal offences. However, the religious trigger in this case required separate verification. The victim's Hindu identity and the accused's religious identities, by themselves, did not establish that the crimes were religiously motivated. At the same time, the social media allegations of conversion raised a question that warranted further scrutiny, particularly because the victim was a Hindu minor. The Hinduphobia Tracker follows a stringent verification process and carefully scrutinises cases in which the religious trigger cannot be independently established. Therefore, despite the social media allegations of conversion, and precedence where several such cases occur on a daily basis, the case was placed in the Undecided database rather than classified as a confirmed religiously motivated hate crime. If further information emerges confirming that the victim was converted to Islam or establishing a religious motive behind the crimes, the case will be reviewed and updated accordingly. Disclaimer: The Hinduphobia Tracker records the incident date based on when the victim's ordeal began, not when the media reported it. In the present case, media reports did not specify the exact date on which the victim's ordeal began and only stated that it began in 2021. Because the media reported the incident on 16 October 2026, we selected an indicative incident date of 16 October 2021 for documentation purposes only, based on the available information.
