Case Summary

A Dalit Hindu woman from the Malihabad area of Lucknow was blackmailed and sexually exploited by a Muslim man named Shahnawaz. The accused trapped her when she was just a minor, subjecting her to caste-based abuse and pressure to convert to Islam. According to her complaint, the incident began in 2020–21 when the victim was just 17 years old and studying in Class 11. She stated that Shahnawaz, a resident of the Nagar Panchayat area, repeatedly followed and harassed her. On 1 January 2021, while she was walking outside her home, he forcibly applied vermilion to the parting of her hair, photographed her with the vermilion and threatened to circulate the photograph on social media. The victim stated that Shahnawaz subsequently used the photograph to blackmail her and repeatedly sexually exploited her. She also stated that he subjected her to casteist abuse and pressured her to recite the Islamic Kalma, abandon Hinduism and convert to Islam. She was also pressured to wear a burqa and stopped from worshipping Hindu gods and goddesses. When the woman's family objected to Shahnawaz's conduct, two of his associates, identified as Siraj and Shahrukh, went to her house. They abused the family and threatened to bring a Maulana to the house to convert the victim to Islam. They also threatened her that they would kill her family if she refused to convert. Subsequently, the victim submitted a complaint at the Malihabad police station on 22 September 2026, detailing the sexual exploitation, blackmail, caste-based abuse, threats and pressure to convert to Islam. As of the date of writing this report, the investigation was ongoing.

It involves the systematic effort, driven by religious malice and indoctrination, to persuade “non-believers’ to accept allegiance, command, or doctrine to and of a contrasting faith. The exploitation of the fiduciary relationship to religiously indoctrinate victims would also be included in this category. Since the underlying animosity towards the victim’s faith forms the basis of predatory proselytization, such cases are considered religiously motivated hate crimes. While every case of conversion of a minor and incidents of establishing a physical relationship with a minor by an adult is a crime, for the purpose of this database, a case would be considered a hate crime only if there is a distinct religious angle to the grooming. For example, in the UK, if a Hindu minor is targeted by Pakistani grooming gangs, it would be considered a hate crime because the victims are specifically targeted owing to their non-Muslim religious identity with the perpetrators being Muslim. Cases where a Hindu woman consensually converts to Islam in a relationship will be left out of the hate crime database, even though it could be argued in several cases that the conversion was a result of religious brainwashing. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman is blackmailed to convert her religion, owing to her religious identity of being a Hindu. Similarly, the worship of the Shivling has been used by supremacist ideologies and religions to denigrate Hindus owing to religious animosity. Such slurs and denigration stem out of inherent animosity and hate towards Hindus and their faith, therefore, it is categorised as hate speech targeted at Hindus specifically owing to their religious identity. Pressuring a Hindu individual to discard her religious faith and embrace another was a direct attack on her religious identity and dignity. It was not a matter of personal choice; it was coercion rooted in hostility towards the victim's Hindu identity. Such an attempt reflects religious animosity because the act was not simply about personal differences but about erasing the victim’s Hindu faith, making it a religiously motivated crime. Thirdly, the religious coercion was further evident in the pressure placed on her to wear a burqa, recite the Kalma, abandon Hinduism and stop worshipping Hindu deities. These demands went beyond an attempt to influence her personal beliefs. They sought to distance her from her existing Hindu faith and practices while exposing her to Islamic religious practices. The restrictions on worshipping Hindu deities were particularly significant because they directly interfered with her ability to practise her own religion. This was done in an effort to weaken her connection with Hinduism and impose Islam on her through coercive circumstances. Furthermore, often in such cases, sexual violence serves a dual purpose: physical subjugation and religious humiliation. The intention was to break the victim down, emotionally, physically, and spiritually, so that she could be converted. This was not random violence; it was systematic, targeted, and rooted in religious animosity. Fourth, the coercive nature of the conversion pressure was further demonstrated by the threats made when she refused to abandon her Hindu faith. She was given death threats if she did not agree to convert to Islam. This was significant because the demand to change her religion was not made as a matter of persuasion or personal choice, but was enforced through fear of serious harm. The use of death threats to secure compliance with a religious demand directly targeted her freedom to retain her Hindu identity and practise her faith. It therefore strengthened the hate-crime dimension by showing that hostility towards her existing religious identity was accompanied by an attempt to compel her to give it up through intimidation. Fifth, the accused also subjected her to casteist abuse. It can be argued that a caste-specific slur is aimed at her micro identity of belonging to the Dalit section of the Hindu community and not her Hindu identity itself. However, as far as Abrahamic religions are concerned, the micro identities of caste, region, and language are secondary. It is the religious identity that drives the animosity of the perpetrator against the Hindu victim. In this case, while the accused hurled caste abuses at the victim, the animosity was driven by his animosity towards Hinduism and Hindus.
