Case Summary

In Silchar, Assam, a minor Hindu girl was deceived into relationship and subjected to prolonged sexual exploitation by a Muslim man named Sujoy Barua, who concealed his true identity and pretended to be a Hindu man. According to reports, the accused, Sujoy Barua alias Borbhuyan alias Barbhua alias Barbhuyia, introduced himself as a Hindu man to the victim and over time, he developed a close relationship with the minor while continuing to hide his real identity. Through this deception, he maintained contact with her for an extended period and subjected her to prolonged sexual exploitation. The incident came to the public's attention when members of the Bajrang Dal traced the pair to a cinema hall in Goldighi Mall in Silchar on 1 July 2026, where they were watching a movie together. The organisation stepped in at the scene and informed the police, after which the Muslim man was taken into custody by the Silchar Police. A case was subsequently registered, and legal proceedings were initiated in connection with the incident. The matter attracted significant attention in the region due to the concealment of identity, the involvement of a minor, and the circumstances under which the relationship had been developed. As of the date of writing this report, the Muslim perpetrator was in police custody.

Why it is Hate Crime ?

The primary category for the case is: Crimes against women in relationships and other sexual crimes. The subcategory for the case is: Man pretending to be Hindu. When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by mala fide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore making it a religiously motivated hate crime. In this incident, a Muslim man hid his true religious identity and took on a Hindu name to build a relationship with a minor Hindu girl. This change in identity was not accidental; it was a key part of how he gained her trust and started their relationship. By presenting himself as a Hindu, he denied the girl the chance to make an informed decision about who he really was. This kind of deception shows a serious betrayal of trust, rather than creating a genuine relationship based on honesty. The accused deliberately concealed his religious identity to initiate and sustain a relationship with the minor Hindu vicitm. This itself is a clear manifestation of bias and malicious intent towards the victim's religion. By concealing his true identity, he exploited her trust, targeting her under false pretences. This indicates a premeditated intent to manipulate her based on her religious background. In cases like these, the tactic of adopting a false Hindu identity to manipulate and "ensnare" a Hindu individual is not just an act of personal betrayal but can also be interpreted as an expression of disdain or disregard for Hinduism and its customs that reflects a deeper animosity towards Hindus and their beliefs. By adopting a Hindu identity, he was able to avoid any trust issues that might have existed because of their different backgrounds. His choice to pretend to be Hindu highlights how important the victim's religious identity was in this deception. This situation fits into what can be called "Man Pretending to be Hindu," where someone misrepresents their faith to gain the confidence of a Hindu girl or woman. In addition, the man had a long-term physical relationship with the minor, which raises serious ethical and legal issues. His actions were intentional and lasted over time, showing that it was not just a simple mistake but a deliberate choice. Such behaviour takes away the victim’s ability to give proper consent and misuses the trust that was built. This incident is a reminder of the need for honesty in relationships, especially regarding identity and background. It is further important to note here that the victim was a minor, and the victim had no mental capacity to understand the evil intention of the perpetrator, which means the element of consent and genuine change of conscience was missing ab initio. Minors, due to their young age and lack of maturity, are particularly vulnerable to manipulation and coercion. They may not have the ability to fully understand the deception, and the Muslim perpetrator purposely targeted and exploited this vulnerability of the victim. Taken together, the facts of this case demonstrated that the accused's actions were not merely acts of individual deception but reflected conduct rooted in religious bias and animosity towards the victim's faith. The deliberate decision to conceal his Muslim identity, assume a Hindu identity, and target a minor Hindu girl demonstrates that her religious identity was central to the manner in which the offence was executed. Consequently, this incident warrants inclusion in the hate crime database as it exhibits clear indicators that the offence was motivated, facilitated, and aggravated by religious bias against the Hindu victim.
