Why it is Hate Crime ?

The primary category for this case is "Predatory Proselytisation". The sub-category for this case is "Harassment, threats, coercion for conversion". Harassment covers a wide range of behaviours of an offensive nature. It is commonly understood as behaviour that demeans, humiliates, and intimidates a person, including threats and coercion. Harassment and threats, in this case, find their root on discriminatory grounds which has the effect of nullifying a person’s rights or infringing upon his freedom to exercise his right specifically owing to the victim’s religious identity. Verbal and physical threats and psychological or physical harassment are often used against Hindu victims because they choose to practice their professed religion. Religious harassment also includes forced and involuntary conversions by harassment, threats or coercion. Coercion includes intimidatory tactics like force-feeding a Hindu victim beef to convert to another religion, forceful circumcision etc. In several cases documented, non-Hindu perpetrators or those who harbour specific animosity towards Hinduism, harass victims simply based on their religious identity. Such cases often also include harassment to ensure the Hindu victim abandons his/her professed religion and adopts the religion of the perpetrator. Such cases where Hindu victims are harassed to convert to the perpetrator’s religion are rooted in animosity towards the victim’s religious identity and are therefore documented as religiously motivated hate crimes. This case carries clear religious markers because the Hindu woman was not only subjected to sexual violence and intimidation, but was also pressured to abandon her Hindu faith and convert to Islam. The conversion pressure was not incidental to the assault. It formed a central component of the coercion directed against the victim, demonstrating that the attack involved an attempt to alter her religious identity through fear, violence, and intimidation. A key religious marker in this case was the use of rape and threats as instruments of religious coercion. According to the complaint, the victim was sexually assaulted and simultaneously pressured to convert to Islam. Religious conversion secured through violence, threats, or sexual domination cannot be considered voluntary because the victim’s ability to exercise free choice is destroyed through fear and coercion. The pressure exerted on the victim therefore reflected not merely criminal violence, but an attempt to force religious submission by overpowering her physically and psychologically. The timing and vulnerability of the victim also carry significance. The woman had only recently arrived at her marital home after her wedding, placing her in a socially and emotionally vulnerable position within an unfamiliar environment. The accused allegedly exploited this vulnerability to target her through sexual violence and religious pressure at a stage when she was least likely to possess social protection or security. The targeting of a newly married Hindu woman in this manner reflected predatory exploitation combined with coercive pressure aimed at weakening her attachment to her existing religious identity. Another important religious marker was the continued threats issued against the victim’s life and property. The intimidation allegedly extended beyond the assault itself and sought to create fear of further harm if the victim resisted or pursued justice. Such threats reinforced the coercive environment surrounding the conversion pressure and demonstrated that violence and fear were being used to suppress resistance and compel compliance. The overall pattern of sexual violence, conversion pressure, and threats demonstrated hostility directed specifically at the victim because she was Hindu and refused to abandon her faith. The conduct reflected more than an ordinary criminal assault. By combining rape, intimidation, and pressure to convert to Islam, the accused allegedly sought to dominate, humiliate, and reshape the victim’s religious identity through coercive means. Taken together, the sexual violence, sustained intimidation, conversion pressure, and threats directed at the Hindu woman established clear markers of religiously motivated targeting. The case therefore reflected coercive religious aggression and hostility towards the victim’s Hindu faith and identity.
