Case Summary

A Hindu minor girl from the Laliya police station area, Balrampur district, Uttar Pradesh, was lured away from her home under the false pretext of marriage by Niyaz Alam, son of Rashid Khan, a Muslim resident of Nai Basti, Kasba Laliya. The victim's father filed a complaint at Laliya police station on 3 May 2026, stating that an unknown individual had enticed his daughter away with the intention of marriage. A case was initially registered under BNS [Bharatiya Nyaya Sanhita] section 87 at Laliya police station. During the investigation, Niyaz Alam was identified as the accused. The investigation confirmed that the victim had been raped and subjected to forced conversion from Hinduism. Following these findings, BNS section 64(1) covering rape and sections 3/5(3) of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act were added to the case. The action was taken under the directions of Superintendent of Police Vikas Kumar and under the supervision of Additional Superintendent of Police Vishal Pandey and Circle Officer Devendra Kumar Shrivastava. A police team under Inspector-in-Charge Santosh Kumar Mishra arrested Niyaz Alam. The arrest team comprised Sub-Inspector Durga Prasad Pandey, Head Constable Manzoor Alam, and Women Head Constable Geeta Verma. The victim was recovered safely and sent to a One Stop Centre for legal support and counselling. The accused was produced in court. Statutory action was stated to be underway.

Why it is Hate Crime ?

The primary category for this case is "Predatory Proselytisation". The sub-category for this case is "Proselytisation by grooming, brainwashing, manipulation or subtle indoctrination". The tertiary categories for this case is "Rape and sexual assault/harassment" and "Conversion of minor". Religious brainwashing essentially means the often subtle and forcible indoctrination to induce someone to give up their religious beliefs to accept contrasting regimented ideas. Religious grooming or brainwashing also involves propaganda and manipulation. It involves the systematic effort, driven by religious malice and indoctrination, to persuade “non-believers’ to accept allegiance, command, or doctrine to and of a contrasting faith. Cases of such grooming or brainwashing are far more nuanced than direct threats, coercion, inducement and violence. In such cases, it is often seen that there is repeated, subtle and continual manipulation of the victim to induce disaffection towards their own faith and acceptance of the contrasting faith of the perpetrator. While subtle indoctrination is widely acknowledged as predatory, an element which is often understated in such conversions or the attempts of such conversion is the role of loyalty and trust which might develop between the perpetrator and the victim. Fiduciary relationships are often abused to affect such religious conversion. For example, an educator transmitting religious doctrine of a competing faith to a Hindu student. The Hindu student is likely to accept what the teacher is transmitting owing to existence of the fiduciary relationship. The exploitation of the fiduciary relationship to religiously indoctrinate victims would also be included in this category. Since the underlying animosity towards the victim’s faith forms the basis of predatory proselytization, such cases are considered religiously motivated hate crimes. Niyaz Alam's conduct followed a methodology that has been documented repeatedly: the false marriage pretext used to lure a Hindu girl away from her family, followed by rape and forced conversion once she had been removed from her social support network. The marriage pretext was not a romantic overture. It was an operational tool designed to exploit the victim's trust to achieve physical separation from her home and community without resistance. The sequence of abduction, rape, and forced conversion reflects a structured and intentional operation. The victim was converted immediately following her removal from her family and her subjection to rape, a sequence that establishes the conversion as the terminal objective of an operation in which sexual violence was deployed as an instrument of religious coercion. The grooming methodology employed in this case, in which a false marriage pretext was used to cultivate the victim's trust before abduction, reflects a pattern of targeting Hindu girls through the exploitation of matrimonial expectations. The victim's willingness to leave with the accused was secured not through force but through the belief that she was entering a legitimate relationship. This manipulation of matrimonial trust as a gateway to abduction and forced conversion is a documented and directional characteristic of predatory proselytisation targeting Hindu women and girls in Uttar Pradesh specifically. It is further important to note here that the victim was a minor, which means the element of consent and genuine change of conscience was missing ab initio. Minors, due to their young age and lack of maturity, are particularly vulnerable to manipulation and coercion. They may not have the ability to fully understand the implications of converting to another religion and the Muslim perpetrator purposely targeted and exploited this vulnerability of the victim. Since this case exemplifies the use of coercion and manipulation to achieve religious conversion, it is a blatant act of religious hate, which is why it has been documented here in the hate tracker. Given that this case met the parameters of a religiously motivated hate crime, Niyaz Alam's conduct reflected more than criminal abduction and sexual assault. By luring a Hindu girl away from her family under the false pretext of marriage, subjecting her to rape, and forcibly converting her from Hinduism to Islam, his actions demonstrated a deliberate and structured effort to permanently separate a Hindu girl from her faith and her family through the sequential deployment of manipulation, sexual violence, and religious coercion. The victim was targeted specifically because she was Hindu, and every instrument of the operation, being false marriage promises, abduction, rape, and forced conversion, was chosen because it would be most effective in removing a Hindu girl from her religious identity under conditions of isolation and physical subjugation. This reflects an underlying hostility toward Hindu religious identity that cannot be characterised as anything other than religiously motivated. Given that this case met the parameters of a religiously motivated hate crime, it was added to the hate crime database of the tracker.
