Why it is Hate Crime ?

This case has been added to the tracker under the primary category- Predatory Proselytisation. Within it, the sub-category selected is Proselytisation by grooming, brainwashing, manipulation or subtle indoctrination. The tertiary categories are - Victim says was brainwashed/groomed, Rape and sexual assault/ harassment and Conversion of minor. Religious brainwashing essentially means the often subtle and forcible indoctrination to induce someone to give up their religious beliefs to accept contrasting, regimented ideas. Religious grooming or brainwashing also involves propaganda and manipulation. It involves the systematic effort, driven by religious malice and indoctrination, to persuade “non-believers’ to accept allegiance, command, or doctrine to and of a contrasting faith. Cases of such grooming or brainwashing are far more nuanced than direct threats, coercion, inducement and violence. In such cases, it is often seen that there is repeated, subtle and continual manipulation of the victim to induce disaffection towards their own faith and acceptance of the contrasting faith of the perpetrator. While subtle indoctrination is widely acknowledged as predatory, an element which is often understated in such conversions or the attempts of such conversion is the role of loyalty and trust which might develop between the perpetrator and the victim. Fiduciary relationships are often abused to affect such religious conversion. For example, an educator transmitting religious doctrine of a competing faith to a Hindu student. The Hindu student is likely to accept what the teacher is transmitting owing to the existence of the fiduciary relationship. The exploitation of the fiduciary relationship to religiously indoctrinate victims would also be included in this category. Since the underlying animosity towards the victim’s faith forms the basis of predatory proselytisation, such cases are considered religiously motivated hate crimes. This case was categorised as a religiously motivated hate crime because the conduct showed a clear pattern of grooming, coercion, and pressure aimed at changing the religious identity of a Hindu minor. Rather than being an isolated offence, it followed a structured progression where the victim’s vulnerability was first identified and then systematically exploited. To begin with, the Muslim accused built repeated and familiar contact with the minor, which gradually lowered her guard. This steady interaction created a position of influence, consistent with grooming, where trust is cultivated over time to gain psychological access. Since the victim was a minor, this influence carried disproportionate weight, making resistance harder and manipulation more effective. Following this stage, the victim was placed under control. Her autonomy was restricted, and access to support systems was cut off. By removing protective surroundings, the accused created an environment where coercion could be sustained. In such circumstances, any apparent compliance cannot be considered voluntary, as it was shaped by dependency, pressure, and limited choices. Moreover, the consent of a minor is not considered valid in any sense. Legally, it is void from the very beginning, and morally it carries no weight because a child does not have the maturity or independence to make such decisions. A minor cannot understand the consequences of sexual or religious choices, and therefore any claim of consent is meaningless. The presence of sexual violence reinforced this control and became part of a continuous pattern of coercive conduct. It was not only physical harm but also a way to assert dominance and suppress resistance. This was then followed by pressure to adopt a different faith, showing that the conduct went beyond personal exploitation and entered the realm of ideological imposition. The insistence on religious conversion of a minor, under conditions of manipulation and coercion, was the clearest indicator of targeted intent. Since a minor cannot make an informed and independent decision about faith, especially in a compromised environment, the attempt to enforce such a change reflected a deliberate effort to displace the victim’s existing religious identity. Therefore, this case was added to the Hinduphobia tracker.
